In order to conscientiously implement the spirit of the document Opinions of Ministry of Human Resources and Social Security and the Ministry of Finance on Solving the Remaining Problems of the Basic Old-age Security for Retirees of Uninsured Collective Enterprises (Ministry of Human Resources and Social Security Fa 107), and in combination with the actual situation in our province, do a good job in the basic old-age insurance for employees of urban collective enterprises and former "May 7th Workers" and "Family Workers", with the consent of the provincial people's government,

I. Scope of personnel

(1) The urban household registration personnel in our province (the city where the household registration pilot is implemented shall be subject to the household registration before the pilot) have established labor relations with the urban collective enterprises in our province for more than 3 years (inclusive) and have not participated in the basic old-age insurance for enterprise employees.

(2) Persons who receive pension subsidies on a monthly basis according to the provisions of No.86 [2009] of Shaanxi People's Social Welfare Department and No.438 [2065] of Shaanxi People's Social Welfare Department (hereinafter referred to as No.86, 126).

II. Audit findings

(a) according to the provisions of this notice, in accordance with the principle of territorial management, I submit a written application for insurance, and the original enterprise or the competent department of the original enterprise shall report it to the administrative department of human resources and social security where the original enterprise is located for confirmation. Among them, the uninsured personnel of collective enterprises at or below the county level shall be identified by the administrative department of human resources and social security at the county level where the original enterprise is located after preliminary examination; Personnel of uninsured collective enterprises at or above the municipal level (including collective enterprises owned by qualified central and provincial enterprises) shall be identified by the municipal administrative department of human resources and social security. The recognized personnel shall pay the basic old-age insurance premium in one lump sum to the corresponding old-age insurance agency in accordance with the regulations, and go through the insurance formalities. The endowment insurance agency shall establish and record personal accounts for it in accordance with the regulations.

(II) When new recruits are identified according to the provisions of this notice, the original enterprise or the competent department of the original enterprise shall be responsible for organizing the preliminary identification work in the early stage, and provide clear file records and other original materials that can prove their work experience to the corresponding human resources and social security administrative department for identification. For those who really can't find all the original archival materials, they can be identified by means of multi-person certification and publicity. I should submit a written application to the enterprise or the competent department of the enterprise to objectively reflect my work experience; At the same time, there should be more than 3 (including 3) original enterprise personnel to provide written proof. The personnel who provide the written certificate shall be the person in charge of the original enterprise or the person in charge of the original enterprise department, as well as the person in charge of the finance department (room) and the person in charge of the workers (class) in the same period. After careful examination, the personnel to be included in the scope of protection shall be publicized for not less than 7 days, and the materials for publicizing the personnel without objection shall be submitted for approval after being stamped with the official seal of the unit.

Third, insurance payment.

(a) since the date of this notice, if the male is under 60 years old and the female is under 50 years old, the insurance payment will be made in the following way.

After 1 and 1993 1 terminate the labor relationship with the original unit, refer to document No.77 [2002] of Shaanxi Labor Society and document No.98 [2009] of Shaanxi People's Society to repay 1993 1 terminate the labor relationship.

2. For urban flexible employees who terminate their labor relations with the original urban collective enterprises, the endowment insurance premium during the flexible employment period can be paid by individuals earlier than 1999 1. Specifically, 60% of the average salary of employees in the province in the previous year is taken as the base, and one-time payment (including interest) is made according to the payment ratio stipulated in previous years. In the future, we will continue to pay insurance premiums according to the policy of flexible employment in cities and towns in our province.

(II) As of the date of issuance of this circular, the specific measures for men over 60 years of age and women over 50 years of age to pay back the old-age pension are as follows: based on 60% of the average salary of employees in the province in the previous year, the old-age insurance premium (including interest) will be paid forward from the month when the insurance formalities are handled. Ignore the same payment period and pay the basic old-age insurance premium in one lump sum15; If the payment period is deemed to be less than 10 year, one-time payment shall be made, and the payment period shall be deemed to be 15 year; If the payment period is deemed to be more than 10 years, the basic old-age insurance premium of 5 years will be paid in one lump sum.

(3) The person who receives the old-age allowance on a monthly basis according to Document No.86 and Document 126 shall submit a written application and pay the basic old-age insurance premium in one lump sum according to the provisions in Item (2) above, and the old-age insurance agency shall establish and record personal accounts for him according to regulations. After comparing the fees paid according to the provisions of Document No.86 and DocumentNo. 126 with the fees calculated according to the above payment methods, we will refund more and make up less. Among them, if the formal employment procedures have been approved by the original labor administrative department at or above the county level or the relevant administrative department, and the original files are complete and clearly recorded, the original recognized administrative department of human resources and social security shall re-examine and determine the continuous length of service. The continuous length of service before 1993 1 is regarded as the payment period, which is combined with the actual payment period.

If I don't want to go through the above procedures or fail to submit a written application, the fees paid according to No.86 and No.26/126 shall be calculated according to the actual payment period of No.5 15, and the payment period shall be regarded as calculated according to the above provisions.

(four) the cost of one-time payment of old-age insurance premiums shall be borne by individuals, and units with conditions may also give appropriate subsidies to individual contributions.

Fourth, the treatment plan

(1) If a minor reaches the age of receiving a pension, and the payment and deemed service period exceed 15 years, and the actual payment period exceeds 5 years, the basic pension shall be calculated and paid according to the new method stipulated in Shaanxi Document No.27 [2006]. When reaching the pension age, if the payment and deemed payment period are less than 15 years or the actual payment period is less than 5 years, I agree and submit a written application, and I can continue to participate in the insurance as an individual. If the monthly payment reaches 15 and the actual payment period is over 5 years, I will retire according to the regulations; If I don't want to continue to pay, the pension insurance relationship will be terminated, and the personal contribution (including interest) will be returned to me in one lump sum.

(2) According to the above regulations, the over-age personnel who pay the basic old-age insurance premium in one lump sum will be paid the basic old-age pension monthly according to the new method stipulated in document No.27 [2006] of Shaanxi Province, and will not participate in the adjustment of the basic old-age pension in the previous year, and will be adjusted with the enterprise retirees in the following years according to the regulations, and enjoy other benefits paid by the enterprise retirees from the old-age insurance fund, among which, the documents No.86 and No.65438 will be implemented.

(III) For those who have received the old-age allowance on a monthly basis according to the provisions of Document No.86 and Document 126, and have not chosen to re-calculate, the monthly basic pension standard will continue to be implemented according to the original payment standard, participate in the adjustment of the basic pension for enterprise retirees in future years, and enjoy other benefits paid by the old-age insurance fund.

(four) during the period of receiving the basic pension on a monthly basis, the basic pension will be stopped from the month after his death, and the funeral expenses will be paid according to the regulations; If the one-time expenses paid by me still have a balance after paying the relevant benefits, the balance will be returned to the designated beneficiary or legal heir.

The funds needed to pay benefits are shared by the endowment insurance fund and financial funds. Among them, the financial burden standard of each city is 100 yuan per person per month (the sharing ratio of cities and counties is determined by the municipal government), and the rest funds are borne by the endowment insurance fund, and the provincial finance subsidizes the endowment insurance fund. (two) by dismissal, sentencing and other sanctions, in accordance with the relevant policies and regulations of the state and our province to calculate the length of service; Working hours that cannot be counted as continuous length of service are not regarded as payment years. Do not pay the old-age insurance premium during the prison term.

(3) This notice shall be implemented as of the date of issuance, and the deadline for insurance premium payment is 20121231; After the implementation of this notice, the documents of Shaanxi Zhengban [2009] No.86 and Shaanxi People's Social Development [2065 438] 10 will no longer be implemented.

Relevant enterprises and their competent departments should accurately publicize policies and conscientiously do a good job in the collection, collation, preliminary identification and submission of relevant information. Human resources, social security, finance and other departments should strengthen work coordination, carry out their duties, do a good job in examination and identification according to regulations, implement the issuance of funds, and ensure the smooth progress of the work. Old-age insurance agencies should do a good job in insurance premium payment and guarantee payment. Violation of policies and regulations in the work, fraud, once found, should be severely punished.
