Shenzhen special economic zone social pension insurance regulations implementation rules

Shenzhen Special Economic Zone Social Pension Insurance Regulations Enforcement Rules include:

1. Participants may not participate in employee basic pension insurance in more than two areas at the same time. Those who have participated in the residents' pension insurance outside the city may not participate in the basic pension insurance for employees in the city upon their own application. Persons who have moved their household registration into the city after reaching the legal retirement age are not included in the city's social pension insurance coverage. If the residents' pension insurance provides otherwise, it shall be subject to its provisions. Outside the city has enjoyed the old-age insurance treatment, not included in the scope of the city's social pension insurance;

2, participants in two or more coordinated areas to participate in social pension insurance, should be in accordance with the relevant provisions of the State for the withdrawal procedures; choose to withdraw from the city's duplication of contributions, the individual contribution part of the principal and interest to return to me, the rest of the transfer to the city's basic old-age insurance fund. If a participant repeatedly participates in the basic pension insurance for employees in the city, he/she chooses to keep one pension insurance relationship, and the other part of the duplicated contributions shall be refunded, of which the principal and interest of the personal contribution part shall be returned to him/her, and the rest shall be transferred to the Basic Pension Insurance Coordination Fund. The local supplementary pension insurance premiums paid shall not be refunded;

3. Those who have received monthly pension insurance benefits outside the city while enjoying monthly pension insurance benefits in the city shall stop enjoying pension insurance benefits in the city; the pension insurance benefits already enjoyed in the city shall be recovered by the municipal social insurance agency (hereinafter referred to as the municipal social insurance agency); the municipal social insurance agency shall, after recovering the corresponding benefits, refund the pension insurance premiums paid in the city, including individual contributions, and the remainder shall be transferred to the Basic Pension Insurance Coordination Fund. After recovering the corresponding benefits, the Municipal Social Security Institution shall refund the pension insurance premiums paid in the Municipality, of which the principal and interest of the personal contribution portion shall be refunded to the person himself/herself, and the rest shall be transferred to the Basic Pension Insurance Coordination Fund, and the local supplementary pension insurance premiums paid shall not be refunded. If a person enjoys pension insurance benefits in the city and then receives monthly pension insurance benefits outside the city, the municipal social security institution will stop issuing his/her pension insurance benefits; if the person himself/herself provides relevant documents to prove that he/she has terminated his/her pension insurance benefits outside the city, he/she may apply for resumption of his/her pension insurance benefits in the city, and the municipal social security institution will resume the payment of his/her pension insurance benefits the month following the month when the payment is terminated by the social security institution outside the city, after verifying the application.

The convergence of basic pension insurance for employees and pension insurance for residents shall be carried out in accordance with the relevant provisions of the State.
