Opinions of Liancheng County Government on Implementing the Interim Measures for Social Assistance
In order to conscientiously implement the spirit of the Interim Measures for Social Assistance (the State Council Decree No.649, hereinafter referred to as the Measures) and the Implementation Opinions of Chongqing Municipal People's Government on Implementing the Interim Measures for Social Assistance in the State Council (Yu Fu Fa [2014] No.55), combined with the actual situation in our district, the following implementation opinions are put forward.
First, strictly control the overall requirements.
(A) grasp the basic principles
Adhere to openness, fairness and justice. Further improve the identification methods and procedures for various social assistance objects. Increase the publicity of policy information, so that the handling process is open and transparent, and the examination and approval results are fair and just.
Adhere to overall planning, coordination and timeliness. We will promote the overall development of urban and rural assistance systems, improve the social assistance system, establish and improve the overall coordination mechanism of social assistance departments, strengthen departmental cooperation, and establish a "one-door acceptance and collaborative handling" platform to provide timely assistance to people in need, so as to ensure that people in need have access to help and get timely assistance.
Adhere to the bottom line, emergency and sustainability. Promote the establishment and improvement of temporary assistance system, actively explore the work of "emergency assistance", give full play to the joint efforts of medical assistance, education aid, housing assistance, employment assistance and other assistance systems and social forces in "emergency assistance", and solve all kinds of sudden, temporary and urgent difficulties.
(B) to strengthen institutional innovation
Further improve the modern social assistance system, which is based on the minimum living guarantee and the support of the extremely poor, supplemented by the living assistance for poor families, the assistance for victims and temporary assistance, supported by special assistance such as medical assistance, education aid, housing assistance and employment assistance, and with the full participation of social forces, so as to ensure the wide coverage, gradient and convergence of social assistance, and the level of assistance is compatible with the level of economic and social development in the region.
The social assistance policy focuses on families with minimum living security and destitute dependents, expands the coverage of low-income families with difficulties, and gives overall consideration to other families with difficulties. Give basic living security to families with minimum living security, and implement special assistance as needed; Providing support for the poor; Provide life assistance to poor families, affected people and temporary relief objects; Implement relevant special assistance to low-income families with difficulties.
(3) Establish and improve the working mechanism
1. Establish an overall coordination mechanism for social assistance. Establish and improve the coordination mechanism of social assistance work, with the deputy head of the District People's Government in charge of civil affairs as the lead, the District Civil Affairs Bureau as the lead, the District Letters and Calls Office, the District Education Commission, the District Public Security Bureau, the District Finance Bureau, the District Judicial Bureau, the District Human Resources and Social Security Bureau, the District Bureau of Land and Housing Management and other relevant departments, the District Health and Family Planning Commission, the District Audit Bureau, the District Statistics Bureau, the District Poverty Alleviation Office, the District Disabled Persons' Federation, the District State Taxation Bureau, the People's Bank of China Changshou District Sub-branch Strengthen departmental cooperation, hold regular or irregular meetings, study and communicate social assistance work, coordinate social assistance work, analyze the problems existing in the work, and study and solve the problems generally reflected by the grassroots and the masses, as well as cases that are strongly reflected by the masses and have great social impact.
2. Establish a "one-door acceptance and collaborative handling" rescue mechanism. The District Civil Affairs Bureau established a comprehensive social assistance management office relying on the subsistence allowance center; Town People's Government (street offices) relies on the government affairs hall to establish a comprehensive service window for accepting social assistance applications, implement the acceptance or transfer of social assistance applications, accept and transfer applications in a timely manner, and ensure that people in need have channels to get help. When applying for social assistance, if it is difficult for the applicant to determine the social assistance management department, he may first ask the town people's government (street office) for help from the comprehensive social assistance service window or the district civil affairs department; After receiving the help, the accepting department shall handle it in time or refer it to the relevant functional departments for handling. Convened by the district government, led by the District Civil Affairs Bureau, with the participation of relevant departments, formulate and improve the workflow of acceptance, sub-office, transfer and feedback. , timely inform or publicly transfer the progress, forming a "one-door acceptance and collaborative handling" departmental cooperation mechanism to ensure that people in need have channels for help and get timely assistance.
3. Establish social forces to participate in social assistance mechanism. It is necessary to widely mobilize social forces to participate in social assistance, give full play to the professional advantages and service expertise of social organizations, social workers, volunteers and other social forces to participate in social assistance, and provide diversified and personalized services such as life assistance, psychological counseling, spiritual comfort, resource link, ability improvement and social integration for different recipients. It is necessary to improve various financial support policies to promote social forces to participate in social assistance, implement financial subsidies, tax incentives, fee reductions and other policies, guide influential charitable organizations and enterprises to set up social assistance public welfare funds, and participate in social assistance through multiple channels and forms. Explore the specific services of social assistance and purchase services from social forces through entrustment, contracting and procurement. Give full play to the characteristics of flexible methods, various forms and one case and one policy, and encourage, guide and support social organizations, enterprises and institutions and caring people to carry out charitable relief for emergency cases.
4. Establish a verification mechanism for the economic situation of social assistance families. The District Civil Affairs Bureau shall establish a verification center for the economic situation of families applying for assistance, and the Town People's Government (street offices) shall set up a verification workstation for the economic situation of families applying for assistance, which shall be fully staffed by means of personnel transfer or purchase of services, and establish a cross-departmental, multi-level and information-sharing social assistance family information verification platform to ensure accurate, efficient and fair identification of social assistance objects. District Public Security Bureau, District Human Resources and Social Security Bureau, District Bureau of Land and Housing Management, District State Taxation Bureau, District Local Taxation Bureau, District Administration for Industry and Commerce, District Provident Fund Management Center, and District Finance and Insurance departments should actively cooperate to provide social assistance agencies with information such as household registration, motor vehicles, employment, housing, insurance, tax payment, individual industrial and commercial households, provident fund, deposits, securities, etc. according to the relevant regulations and the needs of the identification of social assistance objects. Conduct inquiries and inspections on their behalf in a timely manner.
Two, improve and implement the social assistance system and policy.
(A) the implementation of the minimum living security system
1. Rescue the target. The minimum living security is based on family, income and standards, and differential assistance is implemented. The specific conditions for urban and rural households to enjoy the minimum living guarantee include family members, family income, family property and family consumption expenditure. The minimum living security object is a family with local household registration, legal obligations of support, support and maintenance, whose monthly per capita income is lower than the minimum living security standard in this area, and whose family property status and household consumption expenditure meet the relevant provisions.
2. Guarantee standard. The minimum living standard is determined according to the expenses necessary to maintain the basic life of urban and rural residents, and is adjusted in a timely manner with the economic and social development, changes in the living consumption level of urban and rural residents and changes in the price index of basic necessities. When the monthly increase of the consumer price index of the whole city exceeds 3.5% (inclusive) for three consecutive months, the linkage mechanism will be started to issue temporary price subsidies to the registered beneficiaries. When it is less than 3.5% (excluding) for three consecutive months, the linkage mechanism will be suspended and the temporary price subsidy will be stopped. The specific implementation and payment standards shall be implemented in accordance with the standards published by the municipal government or the Civil Affairs Bureau. For families receiving the minimum living guarantee, the district, street and town civil affairs departments shall pay the minimum living guarantee monthly according to the difference between the per capita income of family members living together and the minimum living guarantee standard in this district. For the elderly, school students, preschool children, severely disabled people and seriously ill patients in the minimum living security object, classified key assistance will be implemented.
3. Application review and approval process. Family members living with * * * submit a written application to the town people's government (street office) where the household registration is located; If it is difficult for family members to apply, they may entrust the village (neighborhood) committee to apply on their behalf; Due to special circumstances such as demolition and resettlement, the household registration cannot be moved temporarily, and the habitual residence is inconsistent with the household registration location. The applicant may apply to the town people's government (street office) where the household registration is located with the certification materials issued by the civil affairs department. The Town People's Government (street offices) investigates and verifies the family economic situation of the applicant, organizes democratic appraisal and puts forward preliminary opinions; After examination and publicity, the district civil affairs department shall make a decision on examination and approval. Implement a classification update and regular review system. The minimum living guarantee family shall apply for renewal to the town people's government (street office) one month before the expiration of the renewal period. If the population, income and property status of the minimum living guarantee family changes, the town people's government (street office) shall timely verify and audit, and report to the district civil affairs department for additional issuance, reduction or suspension of the minimum living guarantee according to the time limit.
(2) Improve the support system for the poor.
1. Support objects. The destitute dependents refer to the elderly, the disabled and/or minors under the age of 0/6 with no ability to work, no source of income, no fixed maintenance, support and maintenance obligations or their statutory maintenance, support and maintenance obligations, including children from urban "three noes", rural five guarantees, orphans and eligible families.
2. Support content. Those who meet the conditions for poor support shall be supported according to law. The support system for destitute people should be linked with the basic old-age insurance, basic medical security and minimum living security for urban and rural residents. The town people's government (street offices) should provide basic living, disability care, disease treatment and funeral services for the destitute dependents. The standard of support for destitute personnel is calculated on a monthly basis, and the standard of support for destitute personnel is determined and adjusted according to the standards promulgated by the Chongqing Municipal People's Government. 3. Application review and approval process. To apply for the support of poor people, I shall submit a written application to the town people's government (street office) where the household registration is located; If I have difficulty in applying, I may entrust the village (neighborhood) committee to apply on my behalf. The Town People's Government (street office) investigates and verifies the applicant's health status and family status, puts forward preliminary opinions and publicizes them, and the district civil affairs department conducts examination and approval. Poor support personnel no longer meet the support conditions, villagers' committees, residents' committees or support service agencies shall promptly inform the town people's government, street offices, and terminate the support and publicity after being audited by the town people's government (street offices) and reported to the District Civil Affairs Bureau for approval.
(3) Do a good job in the relief of the affected people.
1. Rescue the target. Give life assistance to people whose basic lives are seriously affected by natural disasters, such as clothing, food, housing and medical care, and ensure that they have food, clothing, clean water and shelter, and they can seek medical treatment in time if they are sick.
2. Rescue content. After the occurrence of natural disasters, emergency response to disaster relief must be started in time. It is necessary to organize the evacuation, transfer and resettlement of the affected people in an orderly manner, provide necessary emergency assistance such as food, drinking water, clothing, temporary shelter, medical and epidemic prevention, and timely verify the disaster situation, verify the subsidy recipients for housing restoration and reconstruction of the affected people, and give financial and material help. For those who were affected by winter cold in that year or spring drought in the following year, temporary basic living assistance was given in time.
3. Rescue procedures. The comprehensive natural disaster emergency coordination agency of the District People's Government shall evacuate, transfer and resettle the affected people according to the situation, and provide necessary emergency assistance to the affected people in a timely manner. After the disaster is stable, the people's governments of towns (street offices) in the affected areas should register the affected people in a timely manner and report to the District Civil Affairs Bureau for the record, and the District People's Government will evaluate, verify and release the natural disaster losses.
4. Job security. Natural disaster relief implements territorial management and graded responsibility. Establish and improve the budget and investment mechanism of natural disaster relief funds to ensure the funds and working funds needed for disaster relief. It is necessary to establish and improve the natural disaster relief system, increase the quantity and variety of relief materials, and ensure that relief materials reach the disaster site within 12 hours after the disaster. The District People's Government shall, according to the characteristics of natural disasters, the number and distribution of residents, establish a natural disaster relief material reserve, and the Town People's Government (street office) shall also establish a natural disaster relief material reserve to ensure the emergency supply of relief materials. Strengthen the construction of natural disaster rescue personnel, professional training and disaster management, and provide necessary transportation and communication guarantee for rescue work.
Increase medical assistance.
1. Rescue the target. It is divided into general medical assistance and emergency medical assistance. General medical assistance targets include: family members with minimum living security, destitute dependents, and other eligible people with special difficulties. The object of disease emergency assistance is mainly patients who are in urgent need of first aid but whose identity is unknown or unable to pay the corresponding expenses. Measures for the confirmation of emergency relief objects and the distribution of relief funds shall be formulated separately.
2. Rescue content. The first is subsidized insurance. Medical assistance adopts a combination of subsidy insurance and subsidy expenses to subsidize the individual contributions of the recipients to participate in medical insurance for urban and rural residents. The second is medical assistance. After the object of assistance is paid by basic medical insurance, serious illness insurance and other supplementary medical insurance, if it is difficult for individuals and their families to bear the basic medical expenses that meet the requirements, they will be given assistance in proportion. Standardize outpatient and inpatient medical assistance for common diseases and improve medical assistance for major diseases. The District People's Government shall, according to the level of economic and social development and the situation of medical assistance funds, reasonably determine the proportion of assistance and the capping line. For patients who need first aid, but whose identity is unclear or unable to pay the corresponding expenses, they should be treated in the nearest medical institution before treatment, and then rescued from the disease emergency relief fund after treatment; In principle, the fund payment is the expenses incurred in first aid within 7 days from the date of first aid, and the payment amount generally does not exceed 1.5 million yuan.
3. Financial guarantee. According to the level of economic and social development and the raising of medical assistance funds, timely study and formulate medical assistance standards, and gradually increase the budget investment of district-level medical assistance funds. The District People's Government shall establish urban and rural medical assistance funds and disease emergency assistance funds to ensure the demand for medical assistance.
4. Rescue management. Improve the medical assistance information management platform, and realize the synchronous settlement of medical expenses connected with medical assistance, basic medical insurance and serious illness insurance. The District Civil Affairs Bureau, together with the District Human Resources and Social Security Bureau and the District Health Planning Commission, signed a service agreement with the designated institutions, regularly checked the medical services and charges of the designated institutions, and seriously investigated and dealt with violations. The District Civil Affairs Bureau should take the lead in improving the policies related to the filing of families with special difficulties in urban and rural areas, standardize the application, review and approval procedures of families with difficulties, strictly review and approve the procedures, and strengthen the dynamic management of the objects that have been included, so that eligible objects can get timely medical assistance and other related assistance and help. The disease emergency rescue system should be connected with other medical security systems.
(5) Strengthen education assistance.
1. Improve various funding policies. Give education subsidies to the minimum living guarantee family members and destitute dependents who receive compulsory education. Education aid will be given to senior high school education (including secondary vocational education), family members of the minimum living guarantee who participate in ordinary higher education, destitute dependents and disabled children who cannot participate in compulsory education according to the actual situation. According to the needs of different stages of education, we will provide assistance by reducing or exempting relevant expenses, granting grants, giving living allowances, and arranging work-study programs to ensure that education helps residents' basic learning and living needs.
2. Fund raising. By collecting social donations and raising funds from schools, students with financial difficulties due to major diseases, natural disasters, traffic accidents and other reasons can be helped to complete their studies.
3. Application review and approval process. Students (or parents) apply for grants from the school and submit relevant certificates or supporting materials. The school conducts a preliminary examination of the student financial aid application, relevant certificates and supporting materials, and publicizes the preliminary examination results. After publicity without objection, it shall be reported to the district department for approval and confirmation, and the school shall implement it in accordance with relevant state regulations.
(6) Key housing assistance.
1. The object and content of assistance. Provide housing assistance to families with minimum living security for housing difficulties and poor people who are supported by dispersion that meet the prescribed standards. Housing difficulties and assistance standards shall be formulated and promulgated by the District People's Government according to the economic and social development level and housing price level of the administrative region. Housing assistance is implemented through physical distribution of rent, payment of housing rental subsidies, and renovation of dilapidated houses in rural areas. Take public (low-cost) rental housing to implement housing assistance, its access conditions, security methods and standards, application for review, distribution and withdrawal shall be implemented in accordance with the relevant policies and regulations of public (low-cost) rental housing within their respective administrative areas.
2. Application review and approval process. When urban families apply for housing assistance, the applicant shall apply to the town people's government (street office) or directly to the District Bureau of Land and Housing Management. After the family income and property status of the District Civil Affairs Bureau and the family housing status of the district housing security department are audited and publicized, the applicants who meet the application conditions will be given assistance by the District Bureau of Land and Housing Management. Rural families applying for housing assistance shall be implemented in accordance with relevant regulations.
3. Financial guarantee. The District People's Government shall, in accordance with the provisions of the state, provide guarantee for the implementation of housing assistance through measures such as financial investment, land supply and preferential taxes and fees.
(7) Further promoting employment assistance.
1. The object and content of assistance. Employment assistance is provided to the members of the minimum living security family who have the ability to work and are unemployed by implementing employment support policies and developing public welfare posts. To apply for employment assistance, the applicant shall register with the subdistrict office, community public employment service agency and public employment service agency after verification, and provide employment services such as employment information, employment introduction and career guidance free of charge.
2. Aid and support policies. If all the working members of the minimum living guarantee family are unemployed, targeted measures should be taken to ensure that at least 1 person in the family is employed. Increase the publicity of employment policies, encourage enterprises to absorb employment assistance objects, encourage employment assistance objects to choose their own jobs and start their own businesses, and give social insurance subsidies and other policy support to those who meet the requirements according to regulations. Use preferential policies such as public welfare post subsidies to attract communities and social units to develop public welfare posts. 3. Obligations of the object of assistance. The minimum living security family members who have the ability to work but are not employed shall accept the work introduced by the public employment service agency; Without justifiable reasons, refused to accept the introduction of their health status and working ability for three consecutive times, and the District Civil Affairs Bureau should reduce or stop issuing their own subsistence allowances.
(8) Improve the temporary assistance system.
1. Rescue the target. The people's governments of all districts shall, in accordance with the Notice on Establishing a Temporary Relief System in an All-round Way issued by the State Council (Guo Fa [2014] No.47) and the spirit of relevant policies of the municipal government, establish and improve a temporary relief system for families with serious difficulties in basic life due to accidents such as fires, traffic accidents and sudden illness of family members; Minimum living guarantee families whose basic life is temporarily seriously difficult because the necessary living expenses suddenly increase beyond the family's affordability; Families that encounter other special difficulties shall be given temporary assistance. Formulate specific identification methods of temporary assistance, clarify the specific types of temporary assistance, and reasonably determine the standards of temporary assistance according to the actual type, degree and self-help ability of the recipients, which is suitable for adjustment.
2. Application review and approval process. To apply for temporary relief, the applicant shall apply to the town people's government (street office), and the village (neighborhood) committees or other units and individuals may apply on their behalf. Town People's Government (street offices) shall, after investigation, review and publicity, report to the district civil affairs department for approval. If the amount of assistance is small, the district civil affairs department may entrust the town people's government (street office) for examination and approval. In case of emergency and need to take immediate measures to prevent irreparable losses or serious consequences that cannot be changed, the Town People's Government (street office) and the District Civil Affairs Bureau shall give first aid; After the state of emergency is lifted, the examination and approval procedures shall be handled in accordance with the regulations. We should take the initiative to find people who encounter sudden, urgent and temporary difficulties in life and give timely help according to regulations.
3. Life is homeless, and vagrants and beggars help. Provide temporary accommodation, emergency treatment, assisted return, etc. For vagrants and beggars who have no source of income. Establish a departmental linkage mechanism. When the staff of the district public security organs and other relevant administrative organs find vagrants and beggars while performing official duties, they shall promptly inform them to seek help from the rescue management agencies; Timely guide and escort the disabled, minors, the elderly and other people with mobility difficulties to the rescue management institutions; In case of sudden illness or illness, it shall immediately notify the first aid agency or send it to a medical institution for treatment. After admission, medical institutions should timely connect with rescue management institutions and do a good job in screening and other related work. Improve the management institutions and service facilities for vagrants and beggars, and form a "three-level" rescue network for district, town (street) and village (neighborhood) committees in accordance with the principle of territorial management and graded responsibility. Properly arrange vagrants and beggars, provide protective assistance to vagrants and minors, effectively strengthen source management, and prevent repeated vagrancy.
4. Financial guarantee. The District Finance Bureau should incorporate temporary relief funds into the budget arrangement and gradually increase investment; If there is a balance in the minimum living security fund, part of the funds can be arranged for the temporary relief expenditure of the minimum living security object.
Third, strengthen job security.
(A) the implementation of work responsibilities
It is necessary to incorporate social assistance into the regional national economic and social development plan, establish and improve the corresponding social assistance coordination mechanism, and organize relevant departments to jointly improve the social assistance system, implement policies, and supervise and manage.
The social assistance work is under the government responsibility system, and the main person in charge of the government is responsible for the social assistance work in this administrative region. The District Civil Affairs Bureau should take the lead in ensuring the minimum living standard, supporting the destitute, providing assistance to the affected people, providing medical assistance, providing temporary assistance, and providing assistance to vagrants and beggars. The district education commission should take the lead in educational assistance; District Guotufangguan Bureau should take the lead to assist in building houses; District human resources and social security departments should take the lead in carrying out employment assistance; The District Health Planning Commission should take the lead in disease emergency rescue; The district finance bureau should do a good job in raising, paying and supervising social assistance funds; Other relevant departments should do a good job in social assistance according to their duties. The Town People's Government (street offices) shall earnestly perform the duties of accepting, investigating and auditing social assistance applications. Village (neighborhood) committees should assist in investigation and verification, democratic hearing (democratic appraisal), posting and publicity.
(2) increase capital investment
It is necessary to improve the social assistance funds and material security mechanism that are compatible with the level of economic and social development in our region, and arrange social assistance funds in full budget. The District Finance Bureau shall, in conjunction with the relevant departments of social assistance, study and formulate measures to ensure the funds for social assistance work, and ensure the needs of the social assistance work of the town (street) and village (neighborhood) committees. Social forces should be encouraged to participate in social assistance through charitable donations and project investment. The District Finance Bureau and relevant social assistance management departments shall improve the management mechanism of social assistance funds, and implement special management, separate accounting and earmarking.
(3) Strengthen capacity building
Effectively strengthen the capacity building of social assistance work, improve the social assistance institutions of the town people's government (street offices), and fully equip the handling personnel. (4) Strengthen supervision and inspection.
The District People's Government will incorporate social assistance into the performance appraisal of the Town People's Government (street offices), and take the implementation of social assistance policies as an important part of supervision and supervision, and organize special inspections on a regular basis. Strengthen the publicity of social assistance laws, regulations and policies, and publicize the implementation of social assistance in a timely manner.
