Three, strengthen the construction of labor security supervision system
(a) the establishment of incentives and credit rating system.
The Municipal Human Resources and Social Security Bureau shall set up a mail box for reporting complaints, publicly report complaints by telephone, and promptly accept the violations of labor security laws and regulations reflected by reporting complaints. If the report is true and provides important clues and evidence for investigating and handling major cases in which employers violate labor security laws and regulations, rewards will be given. Conduct a comprehensive evaluation of the employer's compliance with labor security laws and regulations, establish a credit file, evaluate the credit rating, and announce it to the public through various forms, so as to urge the employer to consciously abide by labor security laws and regulations and create a good legal environment for labor security.
(2) Establish and improve the wage payment guarantee system and the wage payment commitment system for migrant workers.
In the construction, transportation, water conservancy, land and other industries, the wage deposit system for migrant workers will be fully implemented, and the labor security supervision agency will collect the deposit according to a certain proportion of the total project cost before the start of construction. The specific measures for the management of the deposit shall be implemented by the labor security supervision institution in accordance with the relevant provisions, and the financial department shall supervise it.
Establish a wage payment commitment system for migrant workers. Before the project starts, the construction unit shall sign a letter of commitment with the labor security supervision institution to pay the wages of migrant workers. It is strictly forbidden for the construction unit to illegally subcontract the engineering services to unqualified contractors and other organizations or individuals who do not have the qualification of employment subject; The construction unit shall sign a labor contract with the employed migrant workers in accordance with the regulations, specify the payment method, standard and settlement time, and pay the wages of migrant workers directly to the migrant workers themselves on time and in full. Where there is a problem of wage arrears for migrant workers, construction enterprises should restrict their market access, bidding qualifications and construction permits for newly started projects according to law, and impose corresponding penalties. It is necessary to strengthen the linkage between the administration and the judiciary, and increase the prevention and crackdown on unpaid wages. The labor security supervision institution shall establish a ledger for the management of migrant workers' wage payment, and earnestly strengthen the supervision of migrant workers' wage payment. Towns and streets should actively support and cooperate with the labor security supervision work, and submit the wage payment of migrant workers within their jurisdiction to the labor security supervision institutions in a timely manner.
(3) Improve the supervision and restriction mechanism and accountability system of labor security supervision.
The Municipal Human Resources and Social Security Bureau shall establish and implement the system of openness of government affairs and service commitment of labor security supervision, and disclose the basis, procedure, time limit and responsibility of law enforcement; Establish an open, fair and impartial appraisal system, strictly implement the law enforcement responsibility system and the misjudged case investigation system, and take the initiative to accept social supervision. Strengthen the management of law enforcement personnel, strengthen the sense of responsibility, seriously accept, timely intervene and deal with violations of the legitimate rights and interests of workers, and resolutely put an end to abuse of power for personal gain, ultra vires law enforcement and administrative inaction. Further improve the law enforcement methods such as daily patrol inspection, annual inspection, special inspection and acceptance of reports and complaints, and gradually implement grid supervision methods. Serious violations of the legitimate rights and interests of workers due to poor supervision and inspection shall be investigated for the responsibility of relevant personnel; If the complaint is not handled in time according to law or is illegal, the administrative responsibility of the person in charge of the labor security supervision institution and the relevant law enforcement personnel shall be investigated; Supervisors who cause misjudged cases due to intentional and gross negligence shall be investigated for corresponding administrative or legal responsibilities according to law.
All localities and relevant departments should strengthen their sense of responsibility, adhere to the principle of "who is in charge and who is responsible" in engineering projects, and effectively solve the problem of wage arrears for migrant workers. It is necessary to further improve the emergency work mechanism, improve the emergency plan, and properly handle mass incidents caused by wage arrears of migrant workers in a timely manner. If the supervision responsibility is not implemented, the work is not in place, and the government investment projects are in arrears, which leads to serious mass incidents, the directly responsible personnel and relevant leaders should be held accountable.
