Does social security belong to the joint property of husband and wife?

Legal analysis: social security can be used as the common property of husband and wife. Social security includes endowment insurance, unemployment insurance, medical insurance, industrial injury insurance and maternity insurance. Work injury insurance and maternity insurance are paid by the unit and do not belong to the joint property of husband and wife. The other three insurance premiums are paid jointly by enterprises and individuals according to different payment ratios. If one or both spouses have not reached retirement age, they cannot be regarded as the joint property of husband and wife. However, the money actually paid to the social security account belongs to the joint property of husband and wife.

Legal basis: Article 26 of the Supreme People's Court's Interpretation of the Civil Code of People's Republic of China (PRC) on the Application of Marriage and Family stipulates that the income generated by one spouse's personal property after marriage, except fruits and natural appreciation, shall be recognized as the joint property of husband and wife.
