Company doesn't pay social security premiums on full amount of your salary

It is illegal for a company to fail to pay social insurance premiums based on the full amount of your salary.

The legal basis can be found in the following provisions of the Provisional Regulations on the Collection and Payment of Social Insurance Premiums:

Article 4 Contributing units and individuals shall pay social insurance premiums in full and on time.

Article 10: Contributing units must declare the amount of social insurance premiums to be paid to the social insurance administration organization on a monthly basis, and after approval by the social insurance administration organization, they shall pay the social insurance premiums within the prescribed period.

If a contributing unit fails to declare the amount of social insurance premiums to be paid in accordance with the regulations, the social insurance agency shall temporarily determine the amount to be paid based on 110% of the amount of the unit's contributions for the previous month; if there is no amount of the previous month's contributions, the social insurance agency shall determine the amount of the contributions to be paid based on the operating conditions of the unit, the number of its employees and other relevant circumstances. After the contributing unit completes the declaration procedures and pays the social insurance premiums according to the approved amount, the social insurance agency will settle the bill in accordance with the regulations.
