Identification standard of industrial injury

Workers in any of the following circumstances shall be recognized as work-related injuries:

1, who suffers accidental injuries due to work during working hours and workplaces;

2, before and after working hours in the workplace, engaged in work-related preparations or finishing work by accident;

3. Being injured by violence and other accidents during working hours and workplaces due to the performance of duties;

4. Suffering from occupational diseases;

5. When going out to work, he is injured due to work reasons or the whereabouts of an accident are unknown;

6. Being injured by a traffic accident that is not my main responsibility or an urban rail transit, passenger ferry or train accident on the way to and from work;

7. Other circumstances that should be recognized as work-related injuries as stipulated by laws and administrative regulations.

Treatment conditions

The employing unit shall, on the first working day after an employee suffers an accident injury or is diagnosed and identified as an occupational disease according to the provisions of the Law on the Prevention and Control of Occupational Diseases, notify the administrative department of social insurance in the overall planning area and the social insurance agency that participates in the insurance, and, according to the provisions of the Law on the Prevention and Control of Occupational Diseases, submit an application for the identification of work-related injuries to the administrative department of social insurance in the overall planning area within 30 days from the date of the accident injury or the date of diagnosis and identification as an occupational disease.

Note: In case of special circumstances, with the consent of the administrative department of social insurance, the application time limit may be appropriately extended.

Handling materials

1, industrial injury identification application form;

2, the existence of labor relations between the employer and the employee (including factual labor relations) proof materials;

3. Medical diagnosis certificate or occupational disease diagnosis certificate (or occupational disease diagnosis certificate);

4 identification materials (second-generation ID card or household registration book).

Note: The application form for work-related injury identification should include the time, place and cause of the accident and the degree of injury of employees.

Treatment process

1, telephone declaration

The employing unit shall make a telephone declaration to the Municipal Human Resources and Social Security Bureau or the Municipal Social Insurance Fund Management Center on the first working day after the worker suffers accidental injury or is diagnosed and identified as an occupational disease according to the provisions of the Law on the Prevention and Control of Occupational Diseases.

2. Written application

The applicant brings the application materials to the Municipal Human Resources and Social Security Bureau to submit a written application for work-related injury identification.

3. Review materials

The social security department shall examine the applicant's materials. If the materials provided by the applicant for work-related injury identification are incomplete, the social insurance administrative department shall inform the applicant in writing of all the materials that need to be supplemented at one time. The administrative department of social insurance shall accept the corrected materials after the applicant has been informed in writing.

4. Identify applications

The administrative department of social insurance shall make a decision on work-related injury identification within fifteen days from the date of accepting the application for work-related injury identification with clear facts and clear rights and obligations.
