I am an employee of Anmeinuo Factory in Qinghe County. I have no insurance except for work-related injuries. How much can disability be compensated as a long-term disability?

Nine-level disability can be calculated according to the following compensation items.

The main compensation for industrial injury insurance benefits is:

1, one-time disability allowance (9 months' salary)

2. One-time employment subsidy (determined according to the regulations of your province on work-related injuries, received when the labor relationship is terminated, Yunnan salary1February).

3. One-time medical subsidy (determined according to your province's industrial injury regulations, it will be collected when the labor relationship is terminated, and Yunnan is my 3-month salary).

4. Wages during paid shutdown (generally until the Notice of Labor Ability Appraisal Conclusion is issued)

5. Medical expenses, food subsidies, nursing expenses, transportation expenses, etc.

Regardless of whether there is insurance or not, compensation should be calculated according to the Regulations on Industrial Injury Insurance, but: if there is insurance, the social security compensation will be borne by the unit; If there is no insurance, it shall be borne by the unit. Compensation can be calculated according to these items and negotiated with the unit. If negotiation fails, submit an arbitration application to the local labor bureau where you are injured. If it is unreasonable after arbitration, you can bring a lawsuit to the court and appeal to the people's court at the next higher level. The people's court at a higher level is the court of final appeal. If the unit still does not pay compensation, it may apply for compulsory execution.

If there is no contract, you can also ask for double salary during your employment. If no settlement can be reached through normal negotiation, a claim can be submitted to arbitration. If the other party cancels the contract by force, it can claim compensation of one month's salary for one year (the length of service is calculated from 2008).
