Article 44 Employees shall participate in unemployment insurance, by the employer and the employee in accordance with the provisions of the State **** with the payment of unemployment insurance premiums.
Article 45 Unemployed persons shall receive unemployment insurance benefits from the Unemployment Insurance Fund if they meet the following conditions:
(1) If the employing unit and the person himself have paid the unemployment insurance premiums for one year prior to becoming unemployed;
(2) If the interruption of employment is not due to the person's own will;
(3) If the person has already been registered as unemployed and has a requirement to seek employment.
Article 46 If an unemployed person's employer and he or she have accumulated contributions for one year or less than five years before becoming unemployed, the maximum period for receiving unemployment insurance benefits shall be twelve months; if he or she has accumulated contributions for five years or less than ten years, the maximum period for receiving unemployment insurance benefits shall be eighteen months; if he or she has accumulated contributions for ten years or more, the maximum period for receiving unemployment insurance benefits shall be twenty-four months. If one is re-employed and becomes unemployed again, the period of contributions is recalculated, and the period of receiving unemployment insurance benefits is combined with the period of receiving unemployment insurance benefits that should have been received but have not yet been received for the previous period of unemployment, with the maximum period not exceeding twenty-four months.
Article 47 The standard of unemployment insurance benefits shall be determined by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government, and shall not be lower than the standard of minimum subsistence guarantee for urban residents.
Article 48 Unemployed persons shall participate in the basic medical insurance for employees and enjoy basic medical insurance benefits during the period of receiving unemployment insurance benefits.
The basic medical insurance premiums to be paid by the unemployed shall be paid from the Unemployment Insurance Fund, and individuals shall not pay basic medical insurance premiums.
Article 49 If an unemployed person dies while receiving unemployment insurance benefits, a one-time funeral grant and pension shall be paid to his survivors with reference to the local regulations on the death of a working employee. The required funds shall be paid from the Unemployment Insurance Fund.
If an individual dies while meeting the conditions for receiving a basic old-age insurance funeral subsidy, a work-injury insurance funeral subsidy and an unemployment insurance funeral subsidy, his or her survivors may choose to receive only one of these.
Article 50 An employer shall promptly issue a certificate of termination or dissolution of labor relations for an unemployed person and inform the social insurance agency of the list of unemployed persons within fifteen days from the date of termination or dissolution of labor relations.
The unemployed person shall hold the certificate of termination or dissolution of labor relations issued by the employer for him and go to the designated public **** employment service agency for unemployment registration in a timely manner.
With the proof of unemployment registration and personal identification, the unemployed person shall go to the social insurance agency to go through the formalities for receiving unemployment insurance benefits. The period for receiving unemployment insurance benefits is calculated from the date of unemployment registration.
Article 51 An unemployed person shall cease to receive unemployment insurance benefits, and at the same time cease to enjoy other unemployment insurance benefits, if he or she, during the period in which he or she receives such benefits, is under any of the following circumstances:
(1) re-employed;
(2) conscripted to serve in the armed forces;
(3) emigrated to a place outside the country;
(4) enjoying the basic old-age insurance benefits;
(5) enjoying the basic old-age insurance benefits;
(6) unemployed; or
(e) Refusing, without justifiable reasons, to accept appropriate work or training introduced or provided by a department or organization designated by the local people's government.
Article 52 If an employee is employed across the integrated region, his/her unemployment insurance relationship shall be transferred with him/her, and his/her contribution period shall be cumulative.
