Medical expenses for abortion in accordance with family planning policy can be reimbursed by the Maternity Insurance Fund in accordance with the regulations. If the employer has paid the maternity insurance premiums in full and on time, the medical expenses for the birth or induced abortion of a female employee in accordance with the family planning policy, including the prenatal examination fee, delivery fee, surgical fee, hospitalization fee, and medication fee, shall be paid by the maternity insurance fund in accordance with the following standards: 300 yuan for induced abortion in less than 4 months of pregnancy; 1600 yuan for normal delivery or induced abortion in more than 4 months of pregnancy; 2000 yuan for cesarean section delivery; 2000 yuan for caesarean section delivery; and 1600 yuan for cervical section delivery. 2,000 yuan in the case of a surgical delivery; and 3,800 yuan in the case of a caesarean section. In addition, with regard to abortion leave, it is 15 days for abortions of less than two months, 20 days for abortions of more than two months and less than three months, 30 days for induced abortions of more than three months and less than four months, and 42 days for induced abortions of more than four months. The social security office pays the maternity allowance according to the number of days of maternity leave.
Legal basis
The Social Insurance Law of the People's Republic of China Article 58 An employer shall, within 30 days from the date of employment, apply to the social insurance agency for social insurance registration for its employees. If the employer fails to register for social insurance, the social insurance agency shall approve the social insurance premiums to be paid by the employer. Individual entrepreneurs without employees who voluntarily participate in social insurance, part-time workers who do not participate in social insurance with their employers, and other flexibly employed persons shall apply for social insurance registration with the social insurance administration organization. The State establishes a nationally unified individual social security number. Individual social security numbers are citizens' identity numbers.
Special Provisions on Labor Protection for Female Workers and Employees Article 7: Female workers shall be entitled to 98 days of maternity leave for childbirth, of which 15 days may be taken prior to the birth; in the case of a difficult birth, the maternity leave shall be increased by 15 days; and in the case of the birth of a multiple child, the maternity leave shall be increased by 15 days for each additional child. Female workers less than four months pregnant abortion, enjoy 15 days of maternity leave; four months pregnant abortion, enjoy 42 days of maternity leave.
