How to enjoy social security

The conditions for enjoying the basic pension insurance: reaching the legal retirement age, and the accumulated contributions have reached fifteen years, the individuals participating in the basic pension insurance can receive the monthly pension; the conditions for enjoying the unemployment insurance: has paid the unemployment insurance premiums for one year, not because of the interruption of employment of their own will, and has registered as unemployed, and there is a requirement for the laborers to look for a job.

Article 16 of the Social Insurance Law of the People's Republic of China (P.R.C.) stipulates that individuals who have participated in basic old-age pension insurance shall receive a monthly basic old-age pension if they have made contributions for a total of fifteen years by the time they have reached the legal retirement age. Individuals who have participated in basic old-age insurance and have contributed for less than fifteen years by the time they reach the statutory retirement age may contribute until they reach the full fifteen-year limit and receive a basic pension on a monthly basis; they may also be transferred to the new type of rural social old-age insurance or to the social old-age insurance for urban residents, and shall enjoy the corresponding old-age insurance benefits in accordance with the provisions of the State Council. Article 45 of the Law of the People's Republic of China on Social Insurance, the unemployed shall receive unemployment insurance benefits from the Unemployment Insurance Fund if they meet the following conditions: (1) the employer and the unemployed have paid the unemployment insurance premiums for one year before the unemployment; (2) they have interrupted their employment not because of their own will; and (3) they have registered as unemployed and have the requirement of seeking employment.
