Legal Basis: The Military Service Law of the People's Republic of China

Article 5 Citizens of the People's Republic of China, irrespective of ethnicity, race, occupation, family origin, religious beliefs and level of education, are obliged to perform military service in accordance with the provisions of this Law. Citizens with serious physical defects or serious disabilities unfit for military service are exempt from military service. Citizens who have been deprived of their political rights in accordance with the law may not perform military service.

Article 6: Military service is divided into active service and reserve service. Those serving in the Chinese People's Liberation Army in active service are called soldiers; those who have been prearranged to serve in active service or who have been organized into reserve units to serve in the reserves are called reservists.

Article 7 Soldiers and reservists must abide by the Constitution and the laws and fulfill the obligations of citizens, while enjoying the rights of citizens; the rights and obligations arising from military service shall be regulated by this Law and other relevant laws and regulations.
