How to determine the continuous length of service

The continuous length of service is determined according to the social security payment period of employees. Article 38 of the revised draft of the Detailed Rules for the Implementation of the Labor Insurance Regulations

General length of service refers to the working hours of employees whose wage income is their whole or main source of livelihood. When calculating the general length of service, it should include the length of service of the enterprise.

Article 39

The length of service of this enterprise is calculated according to the continuous working hours of employees in this enterprise. Those who leave the company shall be counted from the date of their last return to work in this enterprise. However, under any of the following circumstances, this restriction shall not apply:

A, where the enterprise management, enterprise administration or management to mobilize workers, before and after the transfer in the enterprise's length of service, should be calculated continuously. However, before liberation, the enterprise's length of service can only be calculated continuously if it needs to be transferred for business and has definite proof.

Second, before liberation, workers who worked in this enterprise and were forced to leave and return to this enterprise, if there is a definite proof, are discussed and approved by the trade union group and approved by the labor insurance committee, their working hours before leaving and after returning to this enterprise can be combined and calculated as the length of service of this enterprise.
