Paternity leave pay standard

The paternity leave wage payment standard is the following two points:

1. If the employer has paid social insurance premiums for the employee according to the law, including maternity insurance, the wages during the paternity leave should be paid by the employer to the social security center after applying to the social security center. Paternity leave wages are usually paid in accordance with the local social wage standard. If the employee's wage is higher than the social wage standard, the employer shall make up the difference;

2. If the employer has not paid social insurance premiums for the employee in accordance with the law, the wages during the paternity leave shall be calculated by the employer in accordance with the average contributory wage base for the twelve months prior to the time of the birth of the spouse.

The employer shall pay maternity insurance premiums according to a certain percentage of the total wages of the employees in the unit, and the contribution rate is generally not more than 0.5%, and the specific contribution rate shall be proposed by each co-ordinating region after calculating according to the actual situation of the locality, and then reported to the provinces, autonomous regions and municipalities directly under the central government for approval and implementation.

The employer shall pay maternity insurance premiums in accordance with a certain proportion of the total wages of the employees in the unit, and the proportion of contribution shall not exceed 0.5% in general, and the specific proportion of contribution shall be proposed by the co-ordinating regions after calculation according to the actual situation of the locality, and shall be reported to the provinces, autonomous regions, and municipalities directly under the central government for approval and then be put into effect. More than 0.5% of the total wages, should be reported to the Ministry of Human Resources and Social Security for the record.
