Article 44 of the Labor Contract Law takes "other circumstances stipulated by laws and administrative regulations" as the condition for dissolving the labor contract. Therefore, according to Article 2 1 of the Regulations for the Implementation of the Labor Contract Law, it is mandatory and prohibitive because there are no additional conditions. The retirement age is legal and cannot be adjusted at will, let alone expanded interpretation. You must apply, and the labor contract will of course be terminated when you reach the statutory retirement age.
