The minimum wage generally does not include social security. Minimum wage refers to the minimum labor remuneration that should be paid by the employer in accordance with the law, provided that the worker has provided normal labor during the stipulated working hours. Social insurance refers to a social and economic system that provides income or compensation for the population that is incapacitated, temporarily loses its labor position, or suffers a loss due to health reasons, and the main items include old-age insurance, medical insurance, unemployment insurance, work-related injury insurance, and maternity insurance.

Legal Objective:

Article 6 of the Minimum Wage Regulations determines and adjusts the monthly minimum wage standard with reference to the minimum cost of living of locally employed persons and their supporting population, the consumer price index for urban residents, the social insurance premiums and housing provident funds paid by individual employees, the average wage of employees, the level of economic development, the employment situation, and other factors. Hourly minimum wage standards shall be determined and adjusted on the basis of the enacted monthly minimum wage standards, taking into account the factors of basic old-age insurance premiums and basic medical insurance premiums payable by the organization, and also giving due consideration to the differences between part-time workers and full-time employed persons in terms of job stability, working conditions and intensity of work, and benefits.
