Legal analysis: the disability insurance fund is the employment security fund for the disabled, not social security. Social insurance refers to a non-profit social security system with income redistribution function, which is used by the state to prevent and force most social members to participate. The residual insurance fund refers to the special funds for the employment of disabled persons calculated and paid by organs, organizations, enterprises, institutions and other units. In areas where the employment of disabled persons is decentralized and arranged in proportion, if the proportion of disabled persons does not reach the provisions of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government, it shall be calculated according to local regulations and the annual difference and the average annual salary of local employees in the previous year.

Article 1 This Law is formulated in accordance with the Constitution for the purpose of adjusting the social insurance relationship, safeguarding citizens' legitimate rights and interests in participating in social insurance and enjoying social insurance benefits, enabling citizens to share the fruits of development and promoting social harmony and stability.

Article 2 The state establishes social insurance systems such as basic old-age insurance, basic medical insurance, industrial injury insurance, unemployment insurance and maternity insurance, so as to guarantee citizens' right to receive material assistance from the state and society in accordance with the law in case of old age, illness, industrial injury, unemployment and maternity.
