Provisions of the Ministry of Public Security on Prohibiting Illegal Banquet and Drinking

1. Drinking is prohibited on weekdays;

2. It is forbidden to drink alcohol during duty, duty, attendance, business trip and major security;

3. It is strictly forbidden to drink alcohol in official activities such as law enforcement, attending meetings, learning and training, inspection and supervision, investigation and study, asking for instructions and reporting, and visiting condolences;

4. It is strictly forbidden to gather people to drink alcohol on the grounds of cadre promotion, transfer, retirement, commendation and awards, celebrations, etc.

A mental patient who causes harmful results when he can't identify or control his own behavior and is confirmed by legal procedures shall not bear criminal responsibility, but his family members or guardians shall be ordered to strictly guard and treat him;

Interpretation of "Regulations of the Ministry of Public Security on Prohibiting Illegal Banquet and Drinking"

First item

"It is strictly forbidden to drink alcohol during working hours such as working days, duty, security tasks, business trips, study and training". The "working day" refers to Monday to Friday except Saturday, Sunday and legal holidays. "Other working hours" includes but is not limited to the definitions of working hours in secret service, railway, anti-smuggling, civil aviation, immigration and other systems.

The second item

The term "between leading cadres" in "no banquets between leading cadres and units" refers to cadres who hold leadership positions at all levels and are equivalent to the ranks of four or more staff members, including superiors who are not allowed to entertain subordinates. "Between units" refers to units directly under the Ministry of Public Security, military control units and their internal institutions, as well as units with foreign countries.

The third item

The "subordinates" in the "Prohibition of accepting banquets from subordinates or local public security organs" refers to subordinates with superior-subordinate relations, including both those who have leadership relations with the cadre (colleague relations) and the staff of subordinate units under the leadership or guidance of the cadre (leadership and guidance relations).

The "management and service objects" in the fourth item "No banquets" refer to the units and individuals within the scope of the exercise of functions and powers by public security organs and their subordinate units, as well as those related to their daily operations or business dealings.

Item 5

"It is strictly forbidden to enter and leave private clubs or participate in' one table meal' private clubs, which refer to high-end restaurants, leisure, fitness, beauty, entertainment, accommodation, reception and other places with membership or only open to a few people." "One table of rice" refers to a more hidden illegal banquet form, which avoids traditional places such as restaurants and private clubs and hides in other places that are not used for daily life, such as residential houses, but are specially used for banquets. At the same time, the banquet is small in scale, with only one dining table at the scene, which is close to a "family banquet" in disguise, but its essence is a banquet that may affect the fair execution of official duties.

Item 6

"It is forbidden to drink alcohol at any time and on any occasion" means that in any scene, it is forbidden to drink too much, so as not to cause trouble because of alcohol, which will affect the normal execution of official duties, or stir up trouble, beat and insult others, forcibly take things, damage or occupy public and private property, disturb public order, and even cause drunk driving accidents.
