chapter I general provisions article 1 these regulations are formulated in accordance with the water law of the people's Republic of China, the regulations of the people's Republic of China on river management and relevant national laws and regulations, in combination with the actual situation of our province, in order to strengthen river management, ensure flood control safety and give full play to the comprehensive benefits of rivers. Article 2 These Regulations shall apply to rivers in our province.

the laws and regulations on waterway management shall also apply to the waterway within the river. Article 3 Scope of river course management: Rivers with dikes include waters between dikes on both sides of the strait, regulation works, sandbanks, beaches (including cultivated land and forest land), flood discharge areas and dike protection areas designated by people's governments at or above the county level; The river without dike is determined according to the design flood level, and the river that has not been approved for planning and design is determined according to the highest flood level in history. Article 4 The development and utilization of river resources and the prevention and control of water disasters shall be comprehensively planned, given overall consideration, comprehensively utilized and benefit-oriented, subject to the overall arrangement of flood control and promote the development of various undertakings. The water administrative department of the fifth provincial people's government is the competent authority of the river in the province.

the water administrative department of the people's government at or above the county level is the competent authority for river courses in the administrative area. Article 6 River management shall be based on the principle of combining unified management with hierarchical management. The provincial river authorities shall manage the rivers of major rivers in the province; The rivers of other rivers are managed by the river authorities of cities (prefectures) and counties (cities, districts) according to administrative divisions.

the delineation of major rivers shall be proposed by the provincial river authorities and reported to the provincial people's government for approval. Seventh river flood control and obstacle clearing work to implement the responsibility system of the chief executive of the people's government. Flood control headquarters at all levels shall be responsible for organizing the implementation of flood control and obstacle clearing work in rivers.

all units and individuals have the obligation to protect the safety of river dikes and participate in flood control and emergency rescue. Article 8 The river authorities and river supervisors of the people's governments at all levels must, in accordance with the laws and regulations of the state, strengthen the protection of rivers, strictly implement supervision and management, carry out flood control dispatching orders, and safeguard the safety of river projects and people's lives and property. Chapter II River Regulation and Construction Article 9 River regulation authorities at all levels shall, according to the comprehensive river basin planning, flood control standards, navigation standards and other relevant technical requirements, work out river regulation plans according to the river management authority, and report them to the people's government at the same level for approval and to the river regulation authorities at higher levels for the record.

when compiling the overall urban construction plan for cities along the river, the professional planning of urban river regulation should be organized by the river authorities according to the planning of river basin, flood control and river regulation, and can only be incorporated into the overall urban construction plan after being submitted to the superior river authorities for examination and approval. Article 1 The regulation and utilization of river courses and the construction within the scope of river course management shall be subject to the regulation planning of river courses, so as to maintain the stability of river regime and smooth flood discharge and navigation. Eleventh in the course of river regulation, involving waterway, should take into account the needs of shipping, and solicit the opinions of the transportation department on the relevant design and planning in advance.

the traffic department shall comply with the requirements of flood control safety in waterway regulation, and solicit the opinions of the river authorities on relevant design and planning in advance. Twelfth river regulation, embankment reinforcement and soil need to occupy the land, by the local people's government to solve. The land increased by river regulation belongs to the state and can be used by people's governments at or above the county level for resettlement and river regulation projects. Article 13 The construction of bridges, wharves and other facilities on river courses must be carried out in accordance with the river width determined by the flood control standards stipulated by the state.

the clearance height of pipelines and lines crossing rivers must meet the requirements of flood control. Article 14 For the construction and development of water conservancy, prevention and control of water disasters, regulation of river courses, bridges, wharves, roads, ferries, pipelines, cables and other buildings and facilities that cross rivers, dikes and rivers, the construction unit must submit the project construction plan to the river authorities for examination and approval in accordance with the river course management authority, and then go through the examination and approval procedures in accordance with the basic construction procedures.

after the approval of the construction project, the construction unit shall inform the river authorities of the construction arrangements. Article 15 Newly-built culverts, pumping stations, buried pipelines, cables and other buildings and facilities on dikes shall be put into use only after the completion of the project, and shall be subject to the safety management of the river authorities.

the buildings and facilities mentioned in the preceding paragraph have been built on dikes, and the river authorities shall regularly inspect them. Those that do not meet the safety requirements of the project shall be rebuilt or maintained by the original construction unit within a time limit. Article 16. If it is really necessary to use embankment tops or dikes as roads, it must be approved by the river authorities. The pavement of this embankment section is built and maintained by the traffic or relevant departments.

vehicles are prohibited from passing through dikes or embankments with muddy roads and embankments without roads, except vehicles for flood control and emergency rescue.

all kinds of roads crossing the top of the dike must be filled with approach roads. Article 17 Boundary rivers (except frontier rivers and provincial rivers) and rivers crossing administrative regions are prohibited from unilaterally building drainage, water diversion and water storage projects and river regulation projects in river courses without an agreement reached by the parties concerned or the approval of the river course authorities at higher levels.

the original construction unit shall take remedial measures for the drainage, water blocking, water diversion and water storage projects and river regulation projects that have caused harm to the other bank or the upstream and downstream. If remedial measures cannot be taken, they shall be dismantled within a time limit.
