On the right of permanent residence and household registration

As early as 23, the Ministry of Public Security promulgated and implemented 3 measures to facilitate the people and the people, clearly stipulating that people who have been abroad for more than one year may not cancel their accounts, but those who have settled abroad should cancel their accounts.

In p>25, 28, 21 and 215, the Regulations on the Administration of Permanent Residence in Shanghai all stipulated that those who settled abroad should cancel their accounts.

Article 46 of the new Regulations, which will come into effect on May 1st, refines the operating procedures on the basis of the original regulations.

1. Category of persons who need to cancel their household registration:

Persons who have settled abroad or joined a foreign nationality need to cancel their household registration. Those who have not settled in foreign countries for a long time do not belong to those who should cancel their accounts as mentioned in these Provisions.

2. Conditions for determining that the account needs to be cancelled:

After investigation, the public security organ can cancel the account only if it holds the visa issued by the country where the person lives and contains the reasons of immigration, settlement and permanent residency, and the fact that he has lived and lived in a foreign country for a long time.

Third, the account cancellation can be resumed:

Overseas personnel who have cancelled their accounts can resume their accounts when they return to China to settle down. Among them, those with overseas Chinese status shall be examined and approved by the Municipal Overseas Chinese Affairs Office; Those who do not have the status of overseas Chinese shall be examined and approved by the exit-entry administration department of the Municipal Public Security Bureau.

The summary is as follows:

1. People who have joined foreign nationality or settled abroad need to take the initiative to register and cancel their household registration;

2. If there are no overseas residents who voluntarily apply for cancellation of their accounts, the public security organs can unilaterally cancel their accounts after investigation and have sufficient evidence;

3. Those who have not settled abroad for a long time are not within the scope of people who need to cancel their accounts voluntarily;

4. If you return to China to settle down after your account is cancelled, you can resume your household registration after approval by the Overseas Chinese Affairs Office and the exit-entry administration department.
