What are the conditions and requirements for the H 1B visa for the applicant and his employer?

Requirements for the employer company:

(1) Any company, big or small, can provide H- 1B application support for its foreign employees. However, companies of different sizes need to pay different levels of application fees. Requirements for the applicant:

(1) Professional occupation

Professional posts refer to posts that require professional knowledge, and require workers to apply professional knowledge in theory and practice. Professional posts include but are not limited to: engineers, nurses, professors, researchers, computer programmers and other professional posts;

(2) Educational background requirements

H- 1B usually requires foreign employees to have at least a bachelor's degree or foreign equivalent. If a foreign employee's degree is not obtained in an American university, his degree must be evaluated to determine whether it is equivalent to the corresponding degree awarded by an American university. If the foreign employee has a bachelor's degree issued by an American university or equivalent education abroad, there is no relevant requirement for work experience;

If foreign employees can't meet the educational requirements of H- 1B, they can convert their relevant work experience or training experience into years of education. Generally speaking, the Immigration Bureau believes that three years of professional work experience can be converted into one year of university education.

(4) Practice license

According to state laws, if professional work requires a practice license, then foreign employees must obtain the license.
