Chapter 1 General Provisions Article 1 These measures are formulated in accordance with the "Law of the People's Republic of China on Flood Control" and relevant laws and regulations, and in combination with the actual situation of this province. Article 2 People's governments at all levels shall strengthen unified leadership over flood control work, organize relevant departments and units, mobilize social forces, take measures to strengthen the construction of flood control engineering facilities, consolidate and improve flood control capabilities, and do a good job in flood control and post-flood recovery. and relief efforts. Article 3 The water administrative departments of the people's governments at or above the county level, under the leadership of the people's governments at the same level, are responsible for the organization, coordination, supervision, guidance and other daily work of flood prevention within their respective administrative regions.

River basin management agencies established by the water administrative department of the State Council on important rivers shall perform flood control coordination and supervision and management responsibilities within their jurisdiction in accordance with the law; Water conservancy management agencies, entrusted by the water administrative department, perform flood control-related duties within their jurisdiction.

Relevant local people's governments should strengthen coordination and active cooperation with river basin management agencies to jointly carry out flood control work in the river basin. Chapter 2 Flood Control Planning Article 4 Flood control planning is the basic basis for the management of rivers and lakes, the construction of flood control engineering facilities, and activities related to flood control safety.

Flood control planning should be integrated into the overall plan for national economic and social development. When formulating overall land use plans, urban plans, and other comprehensive and professional plans involving flood control, as well as the layout of major construction projects, flood control safety must be considered, and special plans or demonstrations for flood control and waterlogging must be prepared. Article 5 The preparation and approval of flood control plans for important rivers and lakes determined by the state and urban flood control plans shall be carried out in accordance with the provisions of Article 10 of the Flood Control Law.

The Xiaoqing River, Dagu River, Wei River, Dawen River, Tuhai River, Majia River, Dehui Xin River, Dongyu River, Zhuzhaoxin River, Yi River, Shu River, The flood control plans for the river basins of the Si River, Liangji Canal and Nansi Lake, as well as the flood control plans for the basins across the above-mentioned rivers, shall be prepared by the provincial water administrative department in conjunction with relevant departments and relevant cities (prefectures) and submitted to the Provincial People's Government for approval.

Basin flood control plans for other rivers managed by this province shall be prepared by the water administrative department of the city (region) or county (city, district) where the river is located, in accordance with the management authority, in conjunction with relevant departments, and submitted to the people's government at the same level for approval. Flood control plans for river basins across municipalities (prefectures) and counties (cities, districts) shall be prepared by the water administrative department at the corresponding higher level together with relevant departments and relevant local people's governments, and shall be submitted to the people's government at the same level for approval.

The regional flood control plan shall be prepared by the water administrative department at or above the county level in conjunction with relevant departments based on the river basin flood control plan and submitted to the people's government at the same level for approval.

The flood control plan approved by the people's government must be reported to the water administrative department at the next higher level for record. Article 6 The provincial overall storm surge prevention plan shall be prepared by the provincial water administrative department in conjunction with relevant departments and submitted to the Provincial People's Government for approval.

The water administrative departments at or above the county level in coastal areas shall, in accordance with the provincial master plan for storm surge prevention, work with relevant departments to prepare a storm surge prevention plan for the region, submit it to the people's government at the same level for approval, and report it to the next higher level. The approved storm surge defense plan shall be included in the flood control plan. Article 7 The planned land for river improvement, planned embankment land, and artificial floodway land determined in the flood control plan shall be designated as planned reserved areas in accordance with the law.

The planned reserved areas of the Yellow River, Zhangwei River, Hanzhuang Canal and the rivers and lakes listed in paragraph 2 of Article 5 of these Measures, except those that are subject to national review and approval, shall be determined by the provincial land administration department After verification with the provincial water administrative department in conjunction with relevant regions, it will be reported to the Provincial People's Government for approval in accordance with the authority specified by the State Council and announced.

The planned reserved areas for other river courses shall, after being approved by the relevant land administrative departments and water administrative departments, be reported to the municipal (prefecture) and county (city, district) people's governments for approval in accordance with the prescribed authority and shall be announcement.

If the land within the planned reserve area involves land used for other projects, the relevant land administrative departments and water administrative departments shall seek opinions from the relevant departments when making approval.

In the planned reserved area, no industrial and mining engineering facilities unrelated to flood control or expansion of residential areas shall be built, rebuilt, or expanded; in special circumstances, if it is necessary to occupy the land in the planned reserved area in the preceding paragraph, it shall be in accordance with national regulations The capital construction procedures shall be submitted for approval and the opinions of relevant water administrative departments shall be solicited.

Chapter 3 Control and Protection Article 8 The planned control lines of the Yellow River and inter-provincial rivers and river sections shall be implemented in accordance with the provisions of Article 19 of the Flood Control Law.

Planned control lines for other rivers and river sections shall be formulated by the water administrative department in accordance with the authority to prepare flood control plans in Article 5 of these Measures and submitted to the people's government at the same level for approval. Article 9 Water administrative departments at or above the county level and other relevant departments shall, in accordance with the flood control plan, formulate plans for river regulation, waterlogged area management, reservoir reinforcement, tidal embankment construction, and urban drainage facility construction, and organize their implementation after approval by the people's government at the same level.

The management and development of estuaries and coastal tidal flats should be subject to flood control planning. Article 10 The land required for river regulation according to the flood control plan shall be allocated or adjusted by the people's government at or above the county level in accordance with relevant national regulations.

The newly available land for river regulation shall be owned by the state and shall be uniformly arranged and used by the people's governments at or above the county level, with priority being used for resettlement and the construction and management of flood control engineering facilities.
