Chapter I General Principles

Article 3 The personal dignity and personal safety of nurses are inviolable. Nurses perform their duties according to law and are protected by law.

Article 4 Relevant departments of the State Council, local people's governments at or above the county level and their relevant departments and township (town) people shall take measures to improve the working conditions of nurses, ensure the treatment of nurses, strengthen the construction of nurses, and promote the healthy development of nursing.

Chapter II Practice Registration

Article 7 A nurse shall obtain a nurse's practice certificate after practicing registration.

To apply for nurse practice registration, the following conditions shall be met:

(1) Having full capacity for civil conduct;

(two) in secondary vocational schools and institutions of higher learning to complete more than 3 years of nursing, midwifery and other ordinary full-time professional courses, including teaching and general hospitals to complete more than 8 months of nursing clinical practice, and obtain the corresponding academic certificates;

(3) Having passed the nurse qualification examination organized by the competent health department of the State Council;

(four) in line with the health standards stipulated by the competent department of health in the State Council.

The application for nurse practice registration shall be filed within 3 years from the date of passing the nurse practice qualification examination; If an application is filed within the time limit, in addition to meeting the conditions specified in Items (1), (2) and (4) of the preceding paragraph, it shall also receive clinical nursing training for 3 months in medical and health institutions that meet the conditions specified by the competent health department of the State Council, and pass the examination.

Measures for the qualification examination of nurses shall be formulated by the competent health department of the State Council in conjunction with the personnel department of the State Council.

Article 8 To apply for registration as a nurse practitioner, an application shall be made to the competent health department of the people's government of the province, autonomous region or municipality directly under the Central Government. The competent health department that receives the application shall make a decision within 20 working days from the date of receiving the application, grant registration to those who meet the conditions stipulated in these regulations, and issue a nurse's practice certificate; Do not meet the requirements of this Ordinance, shall not be registered, and explain the reasons in writing.

The validity period of nurse practice registration is 5 years.

Article 9 If a nurse changes her practice place within the validity period of practice registration, she shall report to the competent health department of the province, autonomous region or municipality directly under the Central Government where she intends to practice. The competent health department that receives the report shall handle the change formalities for it within 7 working days from the date of receiving the report. If a nurse changes her practice place across provinces, autonomous regions and municipalities directly under the Central Government, the competent health department that receives the report shall also notify the competent health department of the people of the province, autonomous region and municipality directly under the Central Government where she originally practiced.

Article 10 If a nurse needs to continue practicing after the expiration of the validity period of the practice registration, she shall apply to the health authorities of provinces, autonomous regions and municipalities directly under the Central Government for renewal of the registration 30 days before the expiration of the validity period. The competent health department that has received the application shall grant the extension to those who meet the conditions stipulated in these regulations, and the extension of the practice registration shall be valid for 5 years; Does not comply with the provisions of this Ordinance, shall not be extended, and explain the reasons in writing.

If a nurse should be cancelled in accordance with the provisions of the Administrative Licensing Law, the original registration department shall cancel her practice qualification in accordance with the provisions of the Administrative Licensing Law.

Eleventh local people's health authorities at or above the county level shall establish good and bad records of nurses' practice within their respective administrative areas, and input the records into the nurse practice information system.

The good record of nurses' practice includes the commendation and awards that nurses have received and the completion of mandatory tasks. Bad practice records of nurses include cases where nurses are subject to administrative penalties and sanctions in violation of these regulations and other health management laws, regulations, rules or medical technical specifications.

Chapter III Rights and Obligations

Twelfth nurses have the right to receive wages, enjoy welfare benefits and participate in social insurance in accordance with the relevant provisions of the state. No unit or individual may deduct nurses' salary, reduce or cancel nurses' welfare and other benefits.

Article 13 After practicing, nurses have the right to obtain health insurance and medical care services that are suitable for their nursing work. Nurses who are in direct contact with toxic and harmful substances and are at risk of infectious diseases have the right to accept occupational health supervision in accordance with the provisions of relevant laws and administrative regulations; Those who suffer from occupational diseases have the right to compensation in accordance with the provisions of relevant laws and administrative regulations.
