Measures of Lanzhou Municipality on the Administration of Urban Landscaping

Chapter I General Provisions Article 1 In order to strengthen the planning, construction and management of urban landscaping, improve the greening coverage rate, protect and improve the ecological environment, beautify the city appearance, and improve people's physical and mental health, these Measures are formulated in accordance with the Regulations of the State Council Municipality on Urban Greening and relevant laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the planning, construction, protection and management of landscaping in urban planning areas and town planning areas of this Municipality. Article 3 The term "urban green space" as mentioned in these Measures refers to public green space, residential green space, attached green space, protective green space, production green space and urban scenic forest land. Article 4 The management measures of unified leadership, graded responsibility and the combination of the masses and professional teams shall be implemented for urban landscaping in this Municipality.

The municipal landscaping administrative department shall be responsible for the planning, construction, protection and management of the city's urban landscaping, and guide, supervise and inspect the landscaping work of all districts (counties) and units.

The district (county) administrative department in charge of urban landscaping shall be responsible for the implementation and daily management of urban landscaping planning within its jurisdiction, and guide, supervise and inspect the greening work of units, streets and relevant townships (towns) within its jurisdiction.

Neighborhood offices and relevant township (town) people's governments are responsible for organizing and supervising the greening construction, management and protection of units and residential areas under their jurisdiction and the implementation of responsibilities.

Each unit is responsible for the greening management and protection of its land use scope and responsibility area, and accepts the inspection and guidance of the local people's government and the administrative department of urban landscaping.

Urban construction, planning, municipal administration, city appearance, sanitation, environmental protection, real estate, public security, industry and commerce and other departments shall, within the scope of their respective duties, cooperate with the administrative department of urban landscaping to do a good job in related management. Fifth city, district (county) people's government must strengthen the leadership of urban landscaping, urban landscaping construction as an important part of urban infrastructure construction, into the national economic and social development plan, and arrange the corresponding investment and funds.

City, district (county) people's government and the administrative department of urban landscaping shall encourage and support domestic and foreign organizations and individuals to invest, donate and jointly build urban landscaping projects, and protect their legitimate rights and interests. Article 6 Units and individuals that have made remarkable achievements in the planning, construction, protection, management and scientific research of urban landscaping shall be commended and rewarded by the municipal, district (county) people's government or the administrative department of urban landscaping. Chapter II Planning and Construction Article 7 The urban landscaping construction plan of this Municipality shall be compiled by the municipal urban landscaping administrative department in conjunction with the urban planning administrative department, incorporated into the overall urban planning, and implemented after being examined and approved by the Municipal People's Government.

The district (county) people's government shall, according to the requirements of the city's landscaping construction planning, formulate the landscaping construction planning in this area, and organize the implementation after the approval of the municipal landscaping administrative department. Article 8 The municipal urban planning administrative department and the urban landscaping administrative department shall, according to the relevant provisions of the state and the actual situation of this Municipality, formulate urban greening planning and construction indicators, submit them to the provincial construction administrative department for approval, and accordingly examine and approve the green space planning and construction plans of various development zones and construction projects, and supervise the implementation of various planning indicators of urban greening according to law. Article 9 The design and construction of urban landscaping projects must be undertaken by units with corresponding qualifications. Unlicensed and leapfrog design and construction are strictly prohibited. Tenth city construction, expansion and reconstruction projects and development zones, residential construction projects in the greening project design, must be approved by the municipal administrative department of urban landscaping; Greening costs must be included in the construction project budget; The greening project shall be planned, designed and constructed simultaneously with the main project, and the greening task shall be completed within the prescribed time limit.

The completion and acceptance of the construction project must be attended by the administrative department of urban landscaping. If the greening project fails to pass the acceptance test, the construction unit shall rebuild it or build it on behalf of the greening professional unit, and the construction cost shall be borne by the construction unit. The completed drawing of greening construction project shall be reported to the administrative department of urban landscaping in the district (county) where it is located for the record.

The construction unit must carry out the construction in accordance with the approved or approved greening planning and construction indicators. Due to special circumstances, it is impossible to carry out greening construction according to the prescribed indicators, and it must be approved by the municipal administrative department of urban landscaping. The construction funds of the missing area shall be paid to the municipal administrative department of urban landscaping as compensation, and the urban greening construction shall be arranged in a unified way. Eleventh laying communication, power transmission, gas, water supply and drainage pipelines and erection of public security, bus signs and other public facilities need to occupy urban green space, should take avoidance measures to properly solve. Can not be avoided, the relevant units shall take protective measures in accordance with the requirements of the municipal administrative department of urban landscaping. Chapter III Protection and Management Article 12 All units and individuals within the administrative area of this Municipality have the responsibility and obligation to protect urban green space, trees, flowers and garden facilities, participate in activities of greening and beautifying the city, and have the right to stop, report and accuse the acts of occupying, damaging and destroying urban green space, trees, flowers and garden facilities. Thirteenth the following urban green space, trees and garden facilities management responsibilities are:

(a) the trees and facilities of public green space, production green space, protective green space and scenic forest land shall be managed by the municipal, district (county) urban landscaping administrative department and its subordinate professional units;

(two) the trees and facilities attached to the green space of the unit shall be managed by the unit; The greening and maintenance of protective green space in the unit management area shall be managed by the unit in accordance with the relevant provisions of the state;

(three) the trees and facilities in the green space of residential areas shall be managed by the property unit or the administrative department of urban landscaping of the district (county) according to the actual situation;

(four) the competent departments of railways and highways shall be responsible for the construction and management of greening on both sides of railways and highways in accordance with relevant state regulations.
