Do owners committees and owners’ meetings have the right to recruit new property owners?

The owners' committee and the owners' meeting have the right to recruit new properties.

According to China's "Property Management Regulations" (hereinafter referred to as the Regulations) regarding the owners' meeting and owners' committee, the owners' meeting is composed of all owners and represents and safeguards the legitimate rights and interests of all owners in property management activities. An organization that performs the following six major responsibilities:

1. Formulate and amend the owners' covenant and the rules of procedure of the owners' meeting;

2. Elect and replace members of the owners committee and supervise the work of the owners committee;

3. Selection and dismissal of property management companies;

4. Decide on the use and renewal plans of special maintenance funds, and supervise their implementation;

5. Formulate and modify rules and regulations on the use of public parts of the property and public facilities and equipment, maintenance of public order and environmental sanitation in the property management area;

6. Other property management responsibilities stipulated in laws, regulations or rules of procedure of the owners' meeting.

Article 15 of the "Regulations" stipulates that the owners' committee is the executive agency of the owners' conference and performs the following five responsibilities:

1. Convene a meeting of the owners' meeting to report on the implementation of property management;

2. Sign a property service contract on behalf of the owner with the property management company selected by the owners' meeting;

3. Understand the opinions and suggestions of owners and property users in a timely manner, and supervise and assist property management companies in the performance of property service contracts;

4. Supervise the implementation of the owners' covenant;

5. Other duties assigned by the owners' conference.

Therefore, according to Article 3 of the six major responsibilities of the "Property Management Regulations", the owners' committee and the owners' meeting have the right to select and fire property management companies.
