Regulations on the protection of oil and gas pipelines

Chapter I General Provisions Article 1 These Regulations are formulated for the purpose of ensuring the normal operation of oil and natural gas pipelines and ensuring public safety. Article 2 These Regulations shall apply to land pipelines and ancillary facilities for transporting oil and natural gas owned by the whole people, including:

(1) pipeline and its anticorrosion insulation layer, cathodic protection device and other protection facilities;

(2) Pressure stations, heating stations, metering stations, gas distribution stations, treatment plants, valve rooms, oil depots and their ancillary facilities along the pipeline;

(3) Mark piles, test piles, fences, stay cables and signs along the pipeline.

These Regulations shall not apply to the urban pipe network for transporting oil and natural gas and the internal pipe network of petrochemical enterprises. Article 3 The protection of oil and gas pipelines and their ancillary facilities shall follow the principle of putting prevention first and the principle of combining professional management with mass protection. Article 4 The competent department of energy in the State Council is responsible for the supervision and management of the safety protection of oil and gas pipelines and their ancillary facilities throughout the country. Article 5 Oil and natural gas pipelines (hereinafter referred to as pipelines) and their ancillary facilities, as well as the oil and natural gas transported by pipelines, belong to the state property and are protected by law. No unit or individual may occupy, steal, plunder or destroy. All units and individuals have the obligation to protect pipelines and their ancillary facilities, and have the right to stop and report acts that endanger pipelines and their ancillary facilities to relevant departments. Article 6 The local people's governments at all levels along the pipeline shall publicize and educate the people along the pipeline on pipeline safety protection, and be responsible for coordinating and solving temporary land use and employment related to pipeline inspection, maintenance and emergency repair. Seventh public security organs at all levels along the pipeline are responsible for investigating and handling cases of destruction, theft and looting of pipelines and their ancillary facilities according to law. Chapter II Safety Protection Article 8 Pipeline construction enterprises and pipeline operation enterprises (hereinafter referred to as pipeline enterprises) are responsible for the safe operation of pipelines and their ancillary facilities under their jurisdiction, and their duties are:

(1) During pipeline construction, the pipeline is coated with anti-corrosion insulation layer and cathodic protection device is added;

(two) after the completion of the pipeline, notify the relevant departments in writing of the location of the pipeline, and set up a permanent sign;

(3) Take protective measures and set signs for local pipelines that are vulnerable to vehicle collision and human and animal injuries;

(four) strict implementation of pipeline transportation technology operating rules and relevant safety rules and regulations;

(five) the pipeline and its ancillary facilities, regular inspections, timely maintenance;

(six) pipeline leakage, timely repair;

(seven) to cooperate with the local people's government in the publicity and education of pipeline safety protection for the people along the pipeline;

(eight) to cooperate with the public security organs to do a good job in the safety and security of pipelines and their ancillary facilities. Article 9 Where a pipeline enterprise needs to requisition land for pipeline maintenance, it shall go through the land requisition procedures in accordance with the Land Management Law of the People's Republic of China. Land requisitioned by pipeline enterprises according to law belongs to pipeline enterprises, and no unit or individual may illegally occupy it. Local farmers can plant shallow-rooted crops within the scope of land acquisition after obtaining the consent of pipeline enterprises, but pipeline enterprises will not compensate for the losses caused by crops during pipeline inspection, maintenance and emergency repair. Article 10 Pipeline enterprises may recruit mass line guards along pipelines as needed. Article 11 Oil products leaked and discharged from pipelines shall be recovered and treated by pipeline enterprises, and no unit or individual may take them for himself. Twelfth prohibit any unit or individual from engaging in the following acts that endanger the safety of pipelines and their ancillary facilities:

(a) cutting mountains, blasting, setting off firecrackers and building large-scale projects within 50 meters on both sides of the center line of the pipeline and the outside of the ancillary facilities;

(2) Borrowing soil, digging ponds, quarrying, building houses, building greenhouses, building livestock sheds and building other buildings within five meters on both sides of the central line of the pipeline;

(three) planting deep-rooted plants within five meters on both sides of the center line of the pipeline. Thirteenth blasting in the pipeline center line on both sides of the range of 50 meters to 500 meters, should obtain the consent of the pipeline enterprise in advance, take safety protection measures. Fourteenth for the pipeline crossing the river, the management enterprise and the river management unit shall determine the scope of safety protection through consultation and set up signs. No wharf shall be built in this area, and no anchoring, towing, dredging, damming, fish frying, underwater blasting or other underwater operations that may endanger the safety of pipelines shall be carried out. Fifteenth new power and communication lines through the pipeline pressure station, heating station, metering station, gas distribution station, processing plant and oil depot, should be negotiated with the pipeline enterprises in advance, and take safety measures. Sixteenth rickshaws, animal-drawn carts and motor vehicles are prohibited from driving on the patrol sidewalk above the buried pipeline. It is forbidden for pedestrians to walk on ground pipelines and overhead pipelines or engage in other acts that endanger pipeline safety. Seventeenth it is forbidden for any unit or individual to move, damage or dismantle the signs or protective devices set up to protect the safety of pipelines and their ancillary facilities. Chapter III Handling of the Relationship between Pipeline and Other Construction Projects Article 18 Pipeline enterprises shall inform the local competent department of urban and rural construction planning of the plans to build or rebuild pipelines; The competent department of urban and rural construction planning shall incorporate the newly built and rebuilt pipelines into the urban and rural construction planning.
