Case 1

On the evening of August 16, 2017, a fire broke out in a residential building in a community in Chongqing. Fire trucks entered the community as soon as possible to put out the fire. The fire truck tried to pass, but was stuck on the road and could not move. Finally, he asked the traffic patrol to call the two car owners before moving the vehicle.

The two car owners not only suffered scratches on their cars, but also had their driving licenses temporarily detained by the traffic police.

Case 2

In December 2017, a fire broke out in a community in Shenzhen and three people were trapped. After the police arrived at the scene, they found that the road leading to the community was blocked by a car, and the fire truck was unable to enter the scene. In an emergency, firefighters can only carry equipment and run into the scene to carry out rescue. Fortunately there were no casualties.

Afterwards, the district police found the illegal parking owner that night. Because of illegal parking and hindering the fire truck from performing emergency tasks, the owner was administratively detained for 5 days.

Legal Interpretation

Article 28 of the "Fire Protection Law" stipulates: No unit or individual may damage, misappropriate, or dismantle or decommission fire-fighting facilities and equipment without authorization, and may not bury or occupy them. , Block fire hydrants or occupy fire prevention distances, and shall not occupy, block, or close evacuation passages, safety exits, or fire truck passages. Doors and windows in crowded places shall not be equipped with obstacles that may affect escape, fire fighting and rescue.

Article 60 of the "Fire Protection Law" stipulates: If an unit violates the provisions of this law and commits any of the following acts, it shall be ordered to make corrections and fined not less than 5,000 yuan but not more than 50,000 yuan:

(1) The configuration and setting of fire protection facilities, equipment or fire safety signs do not comply with national standards and industry standards, or are not kept intact and effective; (2) Damage, misappropriation or unauthorized dismantling or deactivation of fire protection equipment Facilities and equipment;

(3) Occupying, blocking, closing evacuation passages, safety exits, or engaging in other behaviors that impede safe evacuation;

(4) Burying pressure, encircling, Blocking fire hydrants or occupying fire prevention distances;

(5) Occupying, blocking, or sealing fire truck passages, hindering the passage of fire trucks;

(6) Setting up doors and windows in crowded places Obstacles that affect escape, fire-fighting and rescue;

(7) Failure to take timely measures to eliminate potential fire hazards after being notified by the fire-fighting and rescue agencies.

If an individual commits any of the acts in Items 2, 3, 4 and 5 of the preceding paragraph, he or she shall be given a warning or be fined not more than 500 yuan.

If a person commits the acts of Items 3, 4, 5 and 6 of Paragraph 1 of this Article and refuses to make corrections after being ordered to do so, enforcement will be carried out and the necessary fees shall be borne by the offender.
