Regulations of Zhejiang Province on Highway Management (revised on 20 17)

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Highway Law of People's Republic of China (PRC) and other relevant laws and regulations, and in combination with the actual situation of this province, in order to strengthen road administration and ensure sound, safe and smooth roads. Article 2 These Regulations shall apply to the administration of state roads, provincial roads, county roads and township roads (including expressways) within the administrative area of this province.

The term "road administration" as mentioned in these Regulations refers to the administrative act of protecting highways, land used for highways and ancillary facilities of highways according to law and managing the construction control areas on both sides of highways in order to ensure the integrity, safety and smoothness of highways. Article 3 People's governments at or above the county level shall strengthen their leadership over road administration.

The traffic administrative departments at or above the county level shall be in charge of road administration within their respective administrative areas. Highway management organizations under the traffic administrative departments at or above the county level shall be responsible for the specific implementation of road administration within their respective administrative areas.

The relevant administrative departments of public security, construction, planning, land resources, water conservancy, industry and commerce, environmental protection, etc. at all levels and the township people's governments along highways shall, within the scope of their respective functions and duties, do a good job in road administration according to law. Article 4 The traffic administrative departments and highway management organizations shall conscientiously perform their duties, do a good job in highway protection according to law, gradually improve highway service facilities, improve highway service and management level, and ensure that highways are always in a good technical state.

The construction and maintenance of highways shall conform to the technical standards for highway engineering and technical specifications for highway maintenance. Fifth road management funds should be included in the government budget. Chapter II Management Duties and Law Enforcement Supervision Article 6 Highway management agencies shall exercise the following road management responsibilities according to law:

(1) Apply for permission to dig, occupy or use highways, and stop and investigate acts of destroying, damaging or illegally occupying highways;

(two) apply for overloading transportation license, stop and investigate illegal overloading transportation;

(three) to manage the establishment and maintenance of highway ancillary facilities;

(four) the management of building control areas on both sides of the highway;

(5) Managing the order of highway construction;

(six) to participate in the design review and completion acceptance of highway projects involving road administration matters;

(seven) the implementation of highway inspection;

(eight) other duties as prescribed by laws and regulations. Seventh traffic administrative departments and highway management agencies should strengthen the construction of law enforcement team, improve the professional quality and law enforcement level of law enforcement personnel. Eighth traffic administrative departments and highway management agencies shall establish a reporting system for road management, and publicly report the telephone number, mailing address or e-mail.

After receiving the report, the traffic administrative department, highway management organization and other relevant departments shall promptly deal with it according to law, and reward the units and individuals who truthfully report it. Ninth road management personnel to carry out supervision and inspection according to law, there should be more than two people to participate in, wear signs, certificates.

Special vehicles for road administration shall be provided with unified signs and warning lights.

Special vehicles for road administration are free to enter the toll roads within their respective jurisdictions when performing official duties. Article 10 When conducting supervision and inspection according to law, road management personnel have the right to know the situation from relevant units and individuals, and to consult and copy relevant materials.

Units and individuals subject to supervision and inspection shall accept the supervision and inspection carried out by road management personnel according to law, and truthfully provide relevant information or explain the situation. Chapter III Highway Protection and Management Section 1 General Provisions Article 11 Highway management agencies shall establish a highway property registration system, investigate and verify highway property according to regulations, and make registration. Article 12 The highway maintenance of toll roads should be gradually marketized, and the maintenance units should be determined through bidding. Thirteenth to encourage the use of van, multi-axle, large, professional cargo transport vehicles engaged in road cargo transport. Article 14 In case of occupying or digging roads, crossing or crossing roads, or erecting or adding pipeline facilities due to the need of engineering construction, the construction unit shall carry out the construction within the road section and time approved by the highway management organization, and set up obvious safety warning signs at the safe distance of the oncoming vehicles at the construction site and take protective measures; After the completion of the construction work, the obstacles on the highway should be quickly removed to eliminate potential safety hazards, and the traffic management department of the highway management organization and the public security organ should resume the traffic in time after passing the acceptance and meeting the traffic requirements.

The traffic administrative department of the public security organ shall strengthen the supervision and inspection of traffic safety, maintain the traffic order of the construction road, and shall not interrupt the traffic. Article 15 Where a highway is damaged due to collapse, potholes, water damage, uplift, etc., or traffic facilities such as traffic lights, traffic signs and markings are damaged or missing, highway management agencies and toll road managers shall set up warning signs and make timely repairs.

If the traffic management department of the public security organ finds that the situation mentioned in the preceding paragraph endangers traffic safety and fails to set warning signs, it shall take timely safety measures to divert traffic and notify the highway management organization or toll road management. Article 16 When dealing with traffic accidents, the traffic management department of the public security organ shall promptly notify the highway management organization or toll road operator if it involves road property damage or road pollution.
