How to Apply for Automatic Import License of Mechanical and Electrical Products

Article 6 For the import of goods subject to automatic import license administration, the import operator shall submit an application for automatic import license to the automatic import license issuing agency authorized by MOFTEC before reporting to the customs.

The customs shall go through the customs declaration formalities with the automatic import license stamped with the special seal for the automatic import license. The bank shall go through the formalities of selling and paying foreign exchange with the Automatic Import License.

Article 7 An import operator shall submit the following materials when applying for automatic import license:

(1) An application form for automatic import license;

(2) Contracts for the import of goods;

(three) a copy of the legal documents approved by the administrative organ for the business scope;

(4) If the import is entrusted, the import contract signed by the consignor and the importer shall be submitted;

(5) Where there are specific provisions on the use or end-user of the imported goods, the certification materials that the use or end-user of the imported goods meets the requirements of the state shall be submitted;

(6) Other materials required to be submitted as stipulated by MOFTEC.

Article 8 The license issuing agency shall immediately approve the license application with correct contents and complete forms upon receipt, and issue the Automatic Import License. Under special circumstances, it shall not exceed ten working days. The license issuing agency shall timely transmit relevant electronic data to MOFTEC as required.

Article 10 Import by the following trade methods shall be exempted from automatic import license:

(1) Processing trade mode.

(2) Imported samples and advertisements.

(3) Other modes of trade that are exempted from automatic import license as stipulated by national laws and regulations.

Eleventh import operators have applied for automatic import license, if not used, should be returned to the original license issuing agency, and explain the reasons; If it is lost, it should be reported to the original license issuing agency immediately, and it will be reissued after verification without adverse consequences.

Article 12 The Automatic Import License shall cease to be issued as of the effective date of the Interim Measures of the State for the Administration of Goods under Automatic Import License which temporarily prohibits or restricts the import quantity.

Article 13 The Automatic Import License shall be subject to the system of "one license per batch", that is, the same Automatic Import License shall not be used for customs declaration in batches.

The automatic import license is valid for six months. If the Automatic Import License needs to be extended or changed, it shall be reapplied and the old license shall be invalidated at the same time.

Article 14 Whoever imports goods with automatic import license without applying for automatic import license in accordance with the provisions of these Measures shall be dealt with in accordance with the relevant provisions of the Customs Law.

Anyone who forges, alters, buys or sells an automatic import license or obtains an automatic import license by cheating or other improper means shall have his automatic import license confiscated according to law, and the MOFTEC may suspend or even revoke his foreign trade business license.

Those who violate the criminal law shall be handed over to the judicial department for criminal responsibility. In order to investigate and deal with illegal cases, the customs may detain the automatic import license according to law.
