Is the roadside parking fee legal?

On-street parking charges are illegal, as follows:

1. According to the law, administrative organs cannot set their own fiscal revenue items. Land belongs to the state and public resources. Vehicle and vessel use fees have been paid, and taxes have been paid according to regulations. In fact, the cost of road use right has been paid. Therefore, it is illegal to impose charges again;

2. Underground parking spaces in residential areas can be sold or rented by agreement. Owners have the ownership of exclusive parts of buildings such as houses and business buildings, and have the right to co-manage the parts other than the exclusive parts.

Ownership of parking spaces and garages planned for parking cars within a building division shall be agreed upon by the parties through sale, gift or lease. Parking spaces that occupy roads or other venues owned by the owner for parking cars shall be owned by the owner. In the building division, the parking spaces and garages planned for parking cars should first meet the needs of the owners.

Legal basis: Article 274 of the Civil Code of People's Republic of China (PRC).

Roads within the building division belong to the owner, except those belonging to urban roads. The green space within the building division belongs to the owner, except for urban public green space or express personal green space. Other public places, public facilities and property services within the building division are owned by the owner.
