Article 1 In order to strengthen the supervision and management of safety production in construction projects, prevent production safety accidents, and ensure the safety of people's lives and property, these Measures are formulated in accordance with the Construction Law of People's Republic of China (PRC), the Safety Production Law of People's Republic of China (PRC) and the Regulations of the State Council on the Administration of Safety Production in Construction Projects, combined with the actual situation of this Municipality.

Article 2 Anyone who engages in related activities such as construction, renovation, expansion and demolition of construction projects within the administrative area of this Municipality, and implements the supervision and management of production safety of construction projects, must abide by these Measures.

The term "construction project" as mentioned in these Measures refers to the construction, decoration and supporting lines, pipelines and equipment installation projects of various houses and their ancillary facilities.

Article 3 The construction administrative department of Dalian Municipal People's Government shall be responsible for the supervision and management of the safety production of construction projects in the whole city. The construction administrative departments of the people's governments of all districts (cities) and counties, and the administrative committees of Dalian Economic and Technological Development Zone, Dalian Bonded Zone, Dalian Hi-tech Industrial Park and Dalian Changxing Island Lingang Industrial Zone are responsible for the supervision and management of the safety production of construction projects, and are responsible for the supervision and management of the safety production of construction projects within their respective jurisdictions according to the division of responsibilities.

Entrusted by the construction administrative department, the construction safety supervision and management institution shall perform the following supervision and management duties:

(a) the supervision and management of the construction industry to implement the national, provincial and municipal laws, regulations, rules and other provisions and standards related to the safety production of construction projects;

(two) in accordance with the relevant provisions of the state, responsible for the assessment of the main person in charge of the construction unit, the person in charge of the project and the full-time safety management personnel;

(four) to investigate, supervise and manage the safety production in the construction site of the construction project;

(five) the implementation of administrative penalties for the safety production management of construction projects;

(six) other matters concerning the supervision and administration of production safety on the construction site of construction projects.

Fourth city and district (city) county government safety production supervision and management departments shall, in accordance with the provisions of the "People's Republic of China (PRC) production safety law", the implementation of comprehensive supervision and management of the safety production of construction projects within their respective jurisdictions.

Article 5 The supervision and management of production safety in construction projects shall follow the principles of combining territorial management with hierarchical supervision, combining the operation of engineering safety guarantee system with the protection of engineering entities, combining comprehensive requirements with key supervision, and combining supervision and law enforcement with service guidance.

Article 6 A construction unit shall perform the following safety responsibilities:

(two) to establish and improve the project safety supervision files;

(three) to establish and improve the responsibility system for production safety and various rules and regulations such as education, training and inspection.

Article 8 A construction unit shall perform the following safety responsibilities:

(a) to participate in the bidding, it shall meet the requirements of safe production conditions;

(two) before the start of construction, in accordance with the provisions of the construction administrative departments for safety production conditions review procedures;

(three) to ensure that the cost of safety protection and civilized construction measures allocated by the project construction unit is stored in a special account and earmarked;

(four) involving deep foundation pit, underground excavation, tall formwork and other projects, the special construction plan should be organized by an expert group of not less than 5 people to demonstrate and review, and can be implemented only after being signed by the technical director of the construction enterprise and the chief supervision engineer;

(five) before the excavation of the deep foundation pit, the construction can be started only after going through the formalities of safety production conditions review and slag discharge for the record with the administrative law enforcement department or the relevant competent department;

(six) the construction site of the construction project is under closed management, and the setting of the on-site enclosure conforms to the provisions and requirements of the construction administrative department;

(seven) to establish and improve the safety management files of engineering projects, obtain the evaluation opinions of the construction safety supervision and management institutions on the safety production of engineering projects, and submit them for the record at the end of acceptance;

(eight) other safety duties as prescribed by laws, regulations and rules.

Article 9 An insurance company shall improve its service mode and service level in the process of operating accident insurance business for construction workers. Through the intermediary organization of construction safety service, we provide the construction unit with safety services such as construction site risk assessment, safety technical consultation, personnel training, disaster prevention and loss prevention equipment configuration, and safety technology research related to accidental injury insurance for construction workers.

Tenth survey, design and other units related to the safety production of construction projects should conscientiously implement the safety responsibilities stipulated by laws, regulations and rules, and accept the supervision and inspection of the construction project safety supervision and management institutions.

Eleventh city and district (city) county government construction administrative departments shall, according to the requirements of the people's government at the same level, formulate emergency rescue plans for major production safety accidents in construction projects within their respective jurisdictions; The establishment of emergency rescue system, the implementation of rescue costs, equipped with necessary emergency rescue equipment, equipment; Organize regular drills and identification and evaluation of major hazard sources; Establish an "expert database" of all kinds of professional and technical personnel involved in construction safety emergency rescue, and establish a communication network.

Twelfth construction units shall formulate their own emergency rescue plans for production safety accidents, and report them to the construction safety management institutions where the enterprises are located and where the construction projects are located for the record; An emergency rescue organization shall be established or equipped with a certain number of emergency rescue personnel, necessary emergency rescue equipment and mechanical equipment, and regular drills shall be organized.

Thirteenth construction safety supervision and management institutions have the right to take the following measures when performing their duties of safety supervision and inspection:

(a) require the inspected units to provide documents and materials related to the safety production of construction projects;

(two) to enter the construction site of the inspected unit for safety inspection;

(three) to correct the violation of safety requirements in the construction;

(four) the hidden dangers of safety accidents found in the inspection shall be ordered to be eliminated immediately; If safety cannot be guaranteed before or during the elimination of major safety accidents, the operators shall be ordered to evacuate the dangerous area or temporarily stop construction.

Article 14 The investigation of production safety accidents in construction projects, the punishment and handling of accident units and responsible persons shall be carried out in accordance with the provisions of relevant laws, regulations and rules.

Fifteenth conscientiously implement these measures, units and individuals that have made remarkable achievements in the management of construction safety production shall be rewarded by the administrative department of construction.
