In the outbound travel business, according to the requirements of the Notice of the National Tourism Administration on Regulating the Relevant Matters of Outbound Travel Margin, when collecting outbound travel margin, each tour group must adopt the fund custody method with the participation of banks, and may not directly collect it in cash or transfer, and may not require tourists to directly deposit the outbound travel margin into personal accounts provided by travel agency staff.

In response to these problems, the National Tourism Administration recently issued the Notice on Standardizing the Operation Behavior of Travel Agencies and Safeguarding the Legal Rights and Interests of Tourists, which put forward requirements for local tourism authorities to perform their duties and standardize the operation behavior of travel agencies, advocate rational consumption of tourists, resist illegal business practices and guard against market risks.

The Notice requires local tourism authorities to regulate the operation behavior of travel agencies. First, strictly control the market risks brought by the operation of tourism package products. Travel agencies are prohibited from charging travel expenses for two or more tourist routes (that is, two or more package tour products) at a time. The second is to strictly investigate the violations in collecting outbound travel deposits. Outbound travel agencies must take the form of fund custody with the participation of banks, and may not directly collect the deposit by cash or cash transfer, and may not require tourists to deposit the outbound travel deposit directly into the corporate account of the travel agency or the personal account of its staff, and may not use the collected outbound travel deposit for other purposes. The third is to crack down on illegal business practices of prepaid cards. Comprehensively investigate the issuance and performance of single-purpose prepaid cards of travel agencies, and it is strictly forbidden to convert single-purpose prepaid cards into multi-purpose prepaid cards without authorization. At the same time, the "Notice" emphasizes that if local tourism authorities find that travel agencies have the above-mentioned violations, they should order them to rectify within a time limit; If it is found that travel agencies have illegal fund-raising and contract fraud, they should promptly notify the financial authorities and public security organs and transfer relevant information and clues.

The relevant person in charge of the supervision and management department of the National Tourism Administration said that the tourism authorities, travel agencies and tourists are the core elements of the tourism market, and they bear the responsibilities and obligations of the regulatory body, the market body and the consumer body respectively. Tourism authorities should strengthen the comprehensive supervision of the market order, travel agencies should standardize their operations, tourists should spend rationally and maintain the order of the tourism market.
