Regulations of Chongqing Municipality on Urban Landscaping

Chapter I General Provisions Article 1 In order to promote the coordinated development of society, economy and environment, improve the ecological environment, beautify the city, and enhance people's physical and mental health, these Regulations are formulated in accordance with the Urban Planning Law of People's Republic of China (PRC), the Urban Greening Regulations of the State Council and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the planning, construction and management of public green space, unit attached green space, residential green space, protective green space, production green space, scenic forest land, urban road greening and attached greening of buildings (structures) within the urban planning area of this Municipality. Third city landscaping should adhere to the following principles:

(1) Unified leadership and graded responsibility;

(2) Unified planning and supporting construction;

(C) the combination of urban ecology and urban landscape construction. Article 4 People's governments at all levels should take the creation of a landscape garden city as the goal, strengthen their leadership over urban landscaping, incorporate urban landscaping into the national economic and social development plan, and organize its implementation. Fifth city landscaping departments responsible for the city's urban landscaping management, and responsible for the management of urban voluntary tree planting according to the division of responsibilities.

District, county (city) department in charge of urban landscaping is responsible for the management of urban landscaping in this area.

Sub-district offices and Town People's governments shall, in accordance with the provisions of these regulations, be responsible for the management of urban landscaping in their respective areas.

State organs, social organizations, military units, schools, enterprises and institutions are responsible for the landscaping management of their own units. Article 6 The competent department of urban landscaping shall carry out, organize and guide relevant units to carry out scientific research on urban landscaping, popularize advanced technologies and continuously improve the level of urban landscaping. Seventh citizens should enhance their awareness of greening, fulfill their greening obligations according to law, and safeguard their own greening achievements and facilities.

Urban landscaping and its facilities are protected by national laws. In violation of the provisions of this Ordinance, any unit or individual has the right to stop and report and accuse. Eighth in the planning, construction and management of urban landscaping, units and individuals that have made remarkable achievements shall be commended and rewarded by the people's governments at all levels or the competent departments of urban landscaping. Chapter II Planning Article 9 The urban landscaping planning of the whole city shall be compiled by the competent department of urban landscaping in conjunction with the competent department of urban planning administration according to the overall urban planning of Chongqing, and implemented after being reported to the Municipal People's Government for approval.

District, county (city) urban landscaping planning by the district, county (city) urban landscaping departments in accordance with the city's urban landscaping planning. Yuzhong District, Jiangbei District, Shapingba District, Jiulongpo District, Nan 'an District, Beibei District, dadukou district, Yubei District and Banan District (hereinafter referred to as the urban area) shall be audited by the district people's government, reviewed by the municipal competent department of urban landscaping, and reported to the municipal planning administrative department for approval; Other districts and counties (cities) shall be reported to the district and county (city) people's government for approval, and sent to the municipal competent department of urban landscaping for the record.

The greening plan prepared by each unit shall be audited by the district and county (city) planning administrative department and the city landscaping administrative department, and reported to the higher authorities for the record. Article 10 The Municipal People's Government shall delimit urban green space protection areas and urban landscaping construction forbidden areas within the urban area, and report to the Standing Committee of the Municipal People's Congress for the record and publication.

Other district and county (city) people's governments shall designate urban green space protection and construction prohibited areas, and report them to the Standing Committee of the people's congress at the same level for the record and announce them to the public. Eleventh public green space, production green space and urban road greening planning shall be compiled and approved in accordance with the following provisions:

(a) municipal management, organized by the competent department of city landscaping, approved by the competent department of city planning administration;

(two) urban management, organized by the district urban landscaping department, reviewed by the district people's government and the municipal urban landscaping department, and approved by the municipal planning administrative department;

(three) other districts and counties (cities) management, by the district and county (city) urban landscaping departments to organize the preparation, reported to the district and county (city) people's government for approval, sent to the city urban landscaping departments for the record. Twelfth approved urban landscaping planning, must be strictly implemented, it is really necessary to change, according to the planning procedures, reported to the original approval authority for approval. Thirteenth urban land area accounts for the total area of construction land planning indicators are:

(a) the transformation of the old city is not less than twenty-five percent;

(two) the development and construction of the new district is not less than thirty percent, of which the per capita public green area of the residential area is not less than one point two square meters;

(3) No less than 40% of the units covering an area of 80 hectares or more, and no less than 40% of the newly-built units with serious pollution, and shelterbelts shall be set up according to regulations;

(four) schools, hospitals, nursing homes (institutes), state organs, social organizations, public cultural and sports venues, military units and other units not less than 35%, other units not less than 30%;

(five) the green coverage rate of urban roads is not less than twenty-five percent, and the green area of new urban trunk roads is not less than twenty percent of the total land area of roads;

(six) rivers, streams, green spaces and railways and highways should be afforested according to the planning and technical specifications.

Urban greening professional nursery area is not less than 2% of the urban built-up area.
