The company bought social security but didn't pay it. How can we save it?

As a kind of employee welfare, social insurance has the nature of property and belongs to property interests. According to China's "General Principles of Civil Law", it is in line with the nature of unjust enrichment to buy one more month of social security for employees after leaving their jobs.

Unjust enrichment refers to the interests that have no legal basis, or lose legal basis afterwards and are identified as causing losses to others, and should bear the responsibility of returning them.

Therefore, the company has the right to recover the overpaid one-month social security from employees.
