How to use the balance of social security card

Legal analysis: There are roughly three ways to use the social security card balance: 1. Can be used for personal medical expenses; 2. The personal account funds of retirees and long-term overseas personnel can be transferred to my social security card financial account and life bank settlement account; 3. Foreigners or Hong Kong, Macao and Taiwan personnel who die, settle abroad or leave the country after the termination of social security relations can pay the balance of their personal accounts in one lump sum.

Legal basis: Article 7 of the Regulations on Employee Medical Insurance: The basic medical insurance premium shall be paid by both the employer and the employee. Among them, the employer pays 5%-7% of the total monthly salary of its employees, and the rate of employees paying basic medical insurance premium is not less than 2% of their total monthly salary.

Article 8 The monthly salary of employees shall be determined according to their actual total wages, but it shall not be less than 60% of the average monthly salary of employees in the city, county and autonomous county where they are located in the previous year. The medical insurance premiums that should be paid by themselves shall be paid by the employer.

Article 9 Where the total monthly salary of employees exceeds 300% of the average monthly salary of employees in cities, counties and autonomous counties in the previous year, the basic medical insurance premium will not be paid, nor will it be used as the base for checking the amount of personal accounts.

Article 10 The employing unit must register the basic medical insurance with the social insurance agency within 30 days after obtaining the business license or being approved to be established. When the registered items change or the payment obligation is terminated according to law, the registration shall be changed or cancelled in time. The social insurance agency shall promptly notify the tax authorities of the registration.

The employing unit shall, within 10 days after going through the basic medical insurance registration formalities, go to the tax collection authority to pay and register the basic medical insurance premium in accordance with relevant regulations.
