Do you need files for retirement?

Retirement procedures require files. The file records the working hours, length of service and professional and technical promotion of workers. If the file age does not match the age of the resident ID card, the file age shall prevail.

If you are an urban and rural residents' endowment insurance insured, you don't need to review personnel files when you retire. When one party retires, the Social Security Council will review his personnel file, and make clear his specific retirement age and time according to the earliest date of birth recorded in his personnel file and the type and gender of his insurance.

If you are an urban employee pension insurance participant, including enterprise personnel (including individual filing, flexible employment, unemployed personnel) and staff of government agencies and institutions, you generally have to review personnel files when you retire, but this does not mean that you cannot retire without files. There are different policies in different places, such as requiring the insured person to sign, declaring that the file is lost, taking full responsibility for the individual and giving up the relevant rights and interests.

Legal basis: Article 1 of the Interim Measures of the State Council on Retirement and Resignation of Workers.

Workers in enterprises and institutions owned by the whole people, party and government organs and mass organizations shall retire if they meet one of the following conditions:

(a) men over 60 years of age, women over 50 years of age, continuous service 10 years.

(two) engaged in underground, high altitude, high temperature, particularly heavy physical labor or other harmful work, men over 55 years of age, women over 45 years of age, continuous service for ten years.

This provision also applies to grassroots cadres whose working conditions are the same as those of workers.

(3) The male has reached 50 years of age and the female has reached 45 years of age, with continuous working years of 10, and has completely lost the ability to work as certified by the hospital and confirmed by the labor appraisal committee.

(four) work-related disability, proved by the hospital, and confirmed by the labor appraisal committee, completely lost the ability to work.
