Chapter I General Provisions Article 1 In order to strengthen the management of urban and rural planning, coordinate the spatial layout of urban and rural construction, and promote the comprehensive, coordinated and sustainable development of urban and rural economy and society, these Regulations are formulated in accordance with the Urban and Rural Planning Law of People's Republic of China (PRC), the Regulations on Urban and Rural Planning of Hubei Province and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the formulation, implementation, revision, supervision and inspection of urban and rural planning within the administrative area of this Municipality and the construction activities within the planning area.

Urban and rural planning as mentioned in these Regulations includes urban system planning, urban planning, town (township) planning and village planning. Urban system planning is divided into urban system planning and county (city) urban system planning. Urban planning and town (township) planning are divided into overall planning and detailed planning. Detailed planning is divided into control detailed planning and construction detailed planning.

The "planning area" as mentioned in these Regulations refers to the built-up areas of cities, towns (townships) and villages, as well as the areas where planning control is required for urban and rural construction and development. The specific scope of the planning area is delineated in the relevant urban and rural planning. Article 3 Cities, counties (cities) and towns (townships) shall formulate urban plans and town (township) plans in accordance with these Regulations.

Central village, characteristic demonstration village, historical and cultural village and traditional village should give priority to the preparation of village planning.

Towns (townships) and villages within the scope of construction land in urban planning areas have not separately compiled town (township) planning and village planning; Villages within the scope of construction land in the town (township) planning area shall not be compiled separately. Article 4 The formulation and implementation of urban and rural planning shall follow the principles of overall planning, coordinated development, environmental friendliness, resource conservation, planning before construction, rational distribution of population, industry, infrastructure and public service facilities in the region, attention to the protection of natural resources such as cultivated land and historical and cultural heritage, maintenance of local characteristics and traditional features, protection and improvement of ecological environment, and satisfaction of disaster prevention and mitigation, public health and public safety. Article 5 After the urban and rural planning is approved according to law, the organization organ shall announce it to the public in time to facilitate public inquiry. The municipal district shall be established by the competent department of urban and rural planning, and shall be responsible for the urban and rural planning and management within its jurisdiction in accordance with the prescribed authority. All kinds of development zones (parks) and key towns (townships) can set up agencies by the competent department of urban and rural planning according to needs to undertake the urban and rural planning and management in this region.

Town (township) people's government, street offices in accordance with the provisions of the responsibilities of urban and rural planning and management within their respective jurisdictions. Article 8 The people's governments of cities and counties (cities) shall set up urban and rural planning committees. The Urban and Rural Planning Committee is the deliberative body of the people's government at the same level in urban and rural planning, and is responsible for deliberating major issues in urban and rural planning and providing a basis for planning and decision-making. The composition and procedure system of the urban and rural planning committee shall be formulated by the people's government at the corresponding level. Article 9 The competent department of urban and rural planning shall carry out planning research, popularize and apply advanced technology, innovate planning methods and management means, strengthen the construction of planning informatization, promote the sharing of information resources, and improve the scientific and technological level and management efficiency of urban and rural planning. Chapter II Formulation and Revision of Urban and Rural Planning Article 10 The formulation of urban and rural planning shall conform to the provisions of national laws and regulations, relevant standards and technical specifications, and shall have basic information such as survey, surveying and mapping, meteorology, geology, hydrology, transportation, environment and cultural relics.

Urban and rural planning should be based on the national economic and social development planning, linked with the overall land use planning, and reflect the requirements of the main functional area planning. Article 11 The scope of the planning area, the scale of construction land in the planning area, the land for infrastructure and public service facilities, water sources and water systems, basic farmland and green land, environmental protection, natural and historical cultural heritage protection, disaster prevention and mitigation, etc. shall be mandatory contents of the overall urban planning and the overall town (township) planning.

The preparation of the next level planning shall not violate or change the mandatory content determined by the previous level planning, and shall make specific arrangements for the mandatory content determined by the previous level planning. Twelfth urban and rural planning organizations shall entrust units with corresponding qualifications to undertake the specific preparation of urban and rural planning.

Planning units shall engage in urban and rural planning within the scope permitted by the qualification grade, and be responsible for the planning quality. Thirteenth urban system planning and urban master planning, town (township) master planning, in accordance with the following provisions:

(a) the regional urban system planning and the overall urban planning shall be organized by the Municipal People's government and submitted to the provincial people's government for examination and approval;

(2) County-level urban system planning and overall urban planning shall be organized by the county-level municipal people's government, and shall be submitted to the provincial people's government for examination and approval after being audited by the municipal people's government;

(three) the county town system planning and the county town master plan shall be organized by the county people's government and submitted to the Municipal People's government for approval;

(four) the overall planning of the town (township) shall be organized by the town (township) people's government, and shall be submitted to the Municipal People's government for examination and approval after being audited by the District People's government; Below the county (city), the county (city) people's government for examination and approval.

Urban system planning, urban master planning and town (township) master planning shall be examined by the Standing Committee of the people's congress at the corresponding level or the town (township) people's congress before being submitted for examination and approval. When submitted for examination and approval, the deliberation opinions and amendments shall be submitted together.
