Regulations of Anhui Province on the Administration of Police Auxiliary Personnel of Public Security Organs
The auxiliary police officers referred to in these Regulations (hereinafter referred to as auxiliary police officers) refer to non-people police officers who are recruited for the society according to the development of social security situation and the actual needs of public security work and provide auxiliary support for the daily operation and police activities of public security organs, including civilian auxiliary police officers and service auxiliary police officers.
Social forces such as public security joint defense, public security volunteers, village protection teams and school protection teams, as well as staff engaged in logistics services such as security, cleaning and catering in public security organs, do not belong to the auxiliary police. Article 3 The management of auxiliary police shall follow the principle of "who uses, who manages and who is responsible", and implement standardized management, clear rights and responsibilities, strict supervision and enhanced guarantee. Article 4 The people's governments at or above the county level shall incorporate the construction of auxiliary police into the special plans related to national economic and social development, scientifically allocate and reasonably control the scale of auxiliary police according to the local economic and social development and social security situation and the principles of appropriate total amount, tilt to the grassroots, dynamic adjustment and classified use, and include the auxiliary police's salary and welfare, equipment installation, education and training and other funds into the fiscal budget at the corresponding level. Fifth public security organs of the people's governments at or above the county level shall be responsible for the management of auxiliary police.
Institutions, civil affairs, finance, human resources and social security, health, retired military affairs and other relevant departments shall, in accordance with their respective responsibilities, do a good job in the management of auxiliary police. Article 6 Auxiliary police officers who have made outstanding achievements and contributions in their posts shall be commended and rewarded in accordance with relevant regulations.
The people's police who employ excellent auxiliary police by public security organs shall be implemented in accordance with relevant state regulations. Chapter II Duties, Rights and Obligations Article 7 The auxiliary police shall perform the work of the auxiliary police under the command of the public security organ or under the leadership of the people's police.
Auxiliary police perform their duties according to law and are protected by law. Citizens, legal persons and other organizations shall support and cooperate with them.
The consequences caused by the auxiliary police performing their duties according to law shall be borne by the local public security organs. Eighth civilian auxiliary police can assist the people's police to carry out the following work:
(a) window service, information collection and entry, wiring (letter) query and other management services;
(two) psychological counseling, medical treatment, translation, computer network maintenance, data analysis, communication security, video surveillance and other professional and technical work;
(three) the custody and maintenance of police equipment and other police security work;
(four) other work that can be carried out according to law.
To carry out the work listed in the preceding paragraph, it is necessary to have corresponding qualifications according to law and obtain corresponding professional qualifications. Article 9 Under the command of the public security organ or the leadership of the people's police, the service auxiliary police shall assist in the following work according to law:
(1) Accepting and handling people's requests for help and resolving contradictions and disputes according to law;
(two) to carry out publicity and education on public security, traffic safety and drug control;
(three) to divert traffic, discourage and correct traffic safety violations;
(four) to maintain the order and safety of the case (incident), protect the case (incident) and rescue the injured and trapped people;
(five) to carry out services such as information collection and registration of floating population;
(six) to carry out patrol, duty and safety inspection;
(seven) to stop the ongoing illegal and criminal activities;
(eight) other work that can be carried out according to law. Article 10 Under the leadership of the people's police, the service auxiliary police shall assist in the following work according to law:
(a) rental housing security management, special industries, drug control, entry and exit, border inspection, entry and exit and other related management services;
(2) Implementing traffic control and traffic safety inspection;
(three) to assist in the investigation, blocking, monitoring and detention of persons suspected of illegal crimes;
(4) Accepting reports, filing cases, accepting evidence, collecting information, mediating and serving documents;
(five) to assist in taking temporary protective restraint measures against drunken people whose behavior is out of control and mental patients who commit violent acts;
(six) the management of supervision places for handling cases;
(7) Maintaining the order of large-scale public activities;
(eight) to participate in the handling of unexpected cases (incidents);
(nine) other work that can be carried out according to law. Eleventh service auxiliary police should be equipped with necessary duty and safety protection equipment when performing tasks, and can drive police cars, boats and other means of transportation; Under the leadership of the people's police, they can assist in the use of binding police equipment in emergency situations that endanger public security, social order and citizens' personal and property safety. Twelfth auxiliary police shall not engage in the following work:
(1) Handling matters involving state secrets;
(2) the case investigation and evidence collection, issue an appraisal report, and identify the responsibility for traffic accidents;
(3) Implementing criminal compulsory measures;
(4) Making administrative decisions;
(5) Examining cases;
(6) Keeping weapons and police equipment;
(seven) other work prohibited by laws, regulations and relevant provisions of the state.
