Regulations of Rizhao Municipality on the Administration of Marine Pasture

Chapter I General Provisions Article 1 In order to standardize the management of marine pastures, protect the marine ecological environment and promote the high-quality development of the marine economy, these Regulations are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the planning and construction, operation and management, ecological protection, supervision and management of marine pastures in the sea areas under the jurisdiction of this Municipality. Article 3 The development of marine pastures shall follow the principles of ecological priority, scientific planning, orderly development and collaborative management. Article 4 The municipal and district people's governments shall strengthen the organization and leadership of the development of marine pastures, incorporate the construction of marine pastures into the national economic and social development plan of the region, establish a comprehensive coordination mechanism for the management of marine pastures, and solve major problems in the development of marine pastures. The funds required for the supervision and management of marine pastures are included in the fiscal budget at the corresponding level.

The people's governments of coastal towns and sub-district offices shall, in accordance with their duties, do a good job in the supervision and management of marine pastures.

Grassroots mass autonomous organizations such as coastal villagers' committees and residents' committees shall assist in the supervision and management of marine pastures. Article 5 The fishery administrative department shall be responsible for the comprehensive management of marine pastures.

Development and reform, science and technology, public security, finance, natural resources and planning, ecological environment, transportation, culture and tourism, emergency management, administrative examination and approval, market supervision and management, sports, meteorology, maritime affairs, marine police, fire rescue and other departments and units shall do a good job in marine pasture related work in accordance with their duties. Article 6 This Municipality and other cities divided into districts in Jiaodong Economic Circle jointly promote the management of the following marine pastures:

(a) the interconnection of marine pasture planning;

(two) the establishment of marine pasture management information communication and major event notification system, realize the sharing of marine pasture management information;

(three) the establishment of law enforcement linkage response and cooperation mechanism;

(4) Other cooperation matters determined through consultation. Article 7 The municipal and district people's governments and relevant departments and units shall strengthen scientific research on the protection and utilization of marine pastures and the popularization and application of advanced technologies, make full use of modern scientific and technological achievements, and enhance the management capacity and development level of marine pastures.

Together with other districts and cities in Jiaodong Economic Circle, the city will strengthen the basic research and technological innovation of marine pasture and related industries, introduce and train high-level scientific research teams and talents, jointly build a high-energy marine pasture scientific and technological innovation platform, jointly promote the transformation of scientific and technological achievements of marine pasture, and enhance the innovation ability of marine pasture and related industries. Article 8 People's governments at all levels shall strengthen the publicity and education of marine ecological protection laws and regulations, and enhance the awareness of aquatic biological resources protection and water ecological environment protection in the whole society.

The news media should promptly and accurately publicize the measures and effects of the construction and management of marine pastures, popularize typical experiences, and create a good public opinion atmosphere for protecting the marine ecological environment and rationally utilizing marine resources.

The city's news media should strengthen the contact and interaction with other news media in Jiaodong Economic Circle, publicize the policies and measures for the construction, operation and management of marine pastures in Jiaodong Economic Circle, popularize work experience, and create a good social environment for win-win cooperation. Chapter II Planning and Construction Article 9 The municipal fishery administrative department shall, jointly with relevant departments, formulate the city-wide marine pasture planning, and organize its implementation after being approved by the Municipal People's Government.

The planning of marine pasture should conform to the national spatial planning, and be connected with the planning of maritime traffic, environmental protection, coastal zone protection, port, tourism and island protection.

Major adjustments to the site selection, area, layout, functions and other contents in the planning of marine pastures shall be re-submitted for approval. Article 10 The construction of marine pasture shall conform to the marine pasture planning, marine environmental protection planning and environmental protection standards, and shall not affect the quality of marine environment or damage the functions of adjacent sea areas. Eleventh marine pasture construction should be based on the functional orientation, reasonable design of artificial reefs and seaweed (grass) field construction, bottom sowing and proliferation, aquatic biological resources proliferation and release, leisure fishery development and other configuration modes, and scientifically determine the construction scale and content. Twelfth marine pasture construction should be carried out in accordance with the law of marine environmental impact assessment.

In the construction of artificial reefs in marine pastures, the examination and approval procedures for the construction of artificial reefs shall be handled according to law. The construction of artificial reefs shall meet the requirements of technical specifications, and the materials of reefs shall meet the environmental protection standards. Thirteenth the construction of marine pasture may cause cross-regional environmental impact, the relevant departments in charge of ecological environment should negotiate. If the conclusion of environmental impact assessment is controversial after consultation, the environmental impact assessment document of marine pasture construction project shall be examined and approved by the common competent department of ecological environment at the next higher level. Fourteenth marine pastures need to support the construction of shore-based facilities, leisure fishing docks, tourist service centers and other functional facilities, the municipal and relevant district people's governments shall give land support for marine pastures supporting facilities according to law. Fifteenth the construction of marine pasture shall obtain the right to use the sea area according to law. The holder of the right to use the sea area shall pay the sea area use fee according to law.

If the term of the right to use the sea area of marine pasture expires and the holder of the right to use the sea area applies for continuing to use the sea area, the people's government that originally approved the use of the sea should approve the renewal according to law, except for the need to recover the right to use the sea area because of public interests or national security.

If the right to use the sea area needs to be recovered in advance due to public interests or national security, it shall be compensated according to the service life of the sea area and the actual situation of the sea area.
